AMENDMENT TO HOUSE BILL 4886

2     AMENDMENT NO. ______. Amend House Bill 4886, on page 1,
3 immediately below line 3, by inserting the following:
 
4     "Section 3. The Illinois Pension Code is amended by
5 changing Section 16-130 as follows:
 
6     (40 ILCS 5/16-130)  (from Ch. 108 1/2, par. 16-130)
7     Sec. 16-130. Creditable service - whole or portion of year.
8     (a) Except as provided in paragraph (6) of subsection (b)
9 of Section 16-127, only one year of service is creditable for
10 all service in any one school year.
11     (b) For employment prior to July 1, 1990, service rendered
12 for the regular legal school term, if creditable hereunder, is
13 equivalent to one year of service, and time less than a legal
14 school term shall be counted as a portion of a year in the
15 ratio that the number of days paid bears to the number of days
16 required at the time to constitute a legal school term;

1 however, service of 170 or more days in any school year after
2 June 30, 1959 shall constitute a year of service.
3     (c) Creditable service for periods of employment after June
4 30, 1990 shall be calculated as follows:
5     For full-time, part-time, and substitute teachers,
6 creditable service in any school year shall be that fraction of
7 a year equal to the ratio of days paid in the legal school
8 term, or the employment agreement if longer, to 170 days.
9     (d) Creditable service for optional service verified after
10 July 1, 1990 for periods of employment prior to July 1, 1990
11 shall be calculated as follows:
12     For full-time, part-time, and substitute teachers,
13 creditable service in any school year shall be that fraction of
14 a year that is equal to the ratio of days paid in the legal
15 school term, or employment agreement if longer, to either the
16 number of days required at the time of service to constitute a
17 legal school term or the number of days in the employment
18 agreement, whichever is greater. However, service of 170 or
19 more days in any school year after June 30, 1959 shall
20 constitute a year of service.
21     (e) For any teacher employed by a school district having
22 adopted an alternative school calendar under Section 10-19.4 of
23 the School Code and whose position requires an additional 75
24 minutes of service per day 4 days per week, service of 135 or
25 more days in any school year during which the alternative
26 school calendar is adopted shall constitute a year of service.

3 2010-2011 school year or the 2011-2012 school year or both, a
4 school"; and
 
5 on page 2, lines 24 and 25, by deleting "every 3 years
6 thereafter"; and
 
7 on page 3, immediately below line 7, by inserting the
8 following:
9     "(d) This Section does not apply to school districts
10 organized under Article 34 of this Code.".
