AMENDMENT TO HOUSE BILL 4452

2     AMENDMENT NO. ______. Amend House Bill 4452 as follows:
 
3 on page 6, by replacing lines 5 through 26 with the following:
4     "(8.5) When nominating papers for the Office of State
5 Representative or State Senator are filed, the candidate named
6 therein may also voluntarily file the results of a substance
7 abuse test conducted on a sample obtained from the candidate
8 within 60 days before the nomination papers are filed. Such
9 voluntary submission of drug testing results shall be
10 subscribed and sworn to by the candidate or nominee before an
11 officer authorized to take acknowledgement of deeds in this
12 State as to whether or not the results are accurate to the best
13 knowledge of the candidate.
14     Substance abuse test results submitted under this Section
15 shall be attached to the nominating petitions submitted by or
16 on behalf of the candidate and shall also be posted on the
17 State Board of Election's website in a manner in which the

1 general public may access the drug testing results."; and
 
2 on page 7, by deleting lines 1 through 18; and
 
3 on page 13, by replacing lines 1 through 2 with the following:
4     "(d) The substance abuse testing authorized and required by
5 this Section does not apply to any resident of a facility
6 licensed or permitted under the Nursing Home Care Act, the Life
7 Care Facility Act, the Assisted Living and Shared Housing Act,
8 the MR/DD Community Care Act, or a facility designated as a
9 supportive living facility under Section 5-5.01a of the
10 Illinois Public Aid Code."; and
 
11 on page 14, by replacing lines 7 through 10 with the following:
12     "(d) The substance abuse testing authorized and required by
13 this Section does not apply to any resident of a facility
14 licensed or permitted under the Nursing Home Care Act, the Life
15 Care Facility Act, the Assisted Living and Shared Housing Act,
16 the MR/DD Community Care Act, or a facility designated as a
17 supportive living facility under Section 5-5.01a of the
18 Illinois Public Aid Code.
 
19     Section 99. Effective date. This Act takes effect January
20 1, 2011.".
