AMENDMENT TO HOUSE BILL 4452

AMENDMENT NO. ______. Amend House Bill 4452 as follows:

on page 6, by replacing lines 5 through 26 with the following:

"(8.5) When nominating papers for the Office of State Representative or State Senator are filed, the candidate named therein may also voluntarily file the results of a substance abuse test conducted on a sample obtained from the candidate within 60 days before the nomination papers are filed. Such voluntary submission of drug testing results shall be subscribed and sworn to by the candidate or nominee before an officer authorized to take acknowledgement of deeds in this State as to whether or not the results are accurate to the best knowledge of the candidate.

Substance abuse test results submitted under this Section shall be attached to the nominating petitions submitted by or on behalf of the candidate and shall also be posted on the State Board of Election's website in a manner in which the general public may access the drug testing results."; and

on page 7, by deleting lines 1 through 18; and

on page 13, by replacing lines 1 through 2 with the following:

"(d) The substance abuse testing authorized and required by this Section does not apply to any resident of a facility licensed or permitted under the Nursing Home Care Act, the Life Care Facility Act, the Assisted Living and Shared Housing Act, the MR/DD Community Care Act, or a facility designated as a supportive living facility under Section 5-5.01a of the Illinois Public Aid Code."; and

on page 14, by replacing lines 7 through 10 with the following:

"(d) The substance abuse testing authorized and required by this Section does not apply to any resident of a facility licensed or permitted under the Nursing Home Care Act, the Life Care Facility Act, the Assisted Living and Shared Housing Act, the MR/DD Community Care Act, or a facility designated as a supportive living facility under Section 5-5.01a of the Illinois Public Aid Code.
