1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Animal Welfare Act is amended by adding
5 Sections 3.3 and 3.4 as follows:
 
6     (225 ILCS 605/3.3 new)
7     Sec. 3.3. Adoption of dogs and cats.
8     (a) An animal shelter or animal control facility shall not
9 adopt out any dog or cat unless it has been sterilized and
10 microchipped. However, an animal shelter or animal control
11 facility may adopt out a dog or cat that has not been
12 sterilized and microchipped if:
13         (1) the adopting owner has executed a written agreement
14     agreeing to have sterilizing and microchipping procedures
15     performed on the animal to be adopted within a specified
16     period of time not to exceed 30 days after the date of the
17     adoption, or
18         (2) the adopting owner has executed a written agreement
19     to have sterilizing and microchipping procedures performed
20     within 14 days after a licensed veterinarian certifies the
21     dog or cat is healthy enough for sterilizing and
22     microchipping procedures, and a licensed veterinarian has
23     certified that the dog or cat is too sick or injured to be

1     sterilized or it would be detrimental to the health of the
2     dog or cat to be sterilized or microchipped at the time of
3     the adoption.
4     (b) An animal shelter or animal control facility may adopt
5 out any dog or cat that is not free of disease, injury, or
6 abnormality if the disease, injury, or abnormality is disclosed
7 in writing to the adopter, and the animal shelter or animal
8 control facility allows the adopter to return the animal to the
9 animal shelter or animal control facility.
10     (c) The requirements of subsections (a) and (b) of this
11 Section do not apply to adoptions subject to Section 11 of the
12 Animal Control Act.

14     Sec. 3.4. Release of animals to shelters. An animal shelter
15 or animal control facility may not release any animal to an
16 individual representing an animal shelter, unless the
17 recipient animal shelter has been licensed or has a foster care
18 permit issued by the Department or the individual is a
19 representative of a not-for-profit, out-of-State organization.
 
20     Section 99. Effective date. This Act takes effect upon
21 becoming law.
