AMENDMENT TO HOUSE BILL 2256

2     AMENDMENT NO. ______. Amend House Bill 2256 by replacing
3 lines 15 through 26 on page 7 and lines 1 through 5 on page 8
4 with the following:
5     "(l) Prior to the release of any inmate, the Department
6 must provide the inmate with the option of testing for
7 infection with human immunodeficiency virus (HIV), as well as
8 counseling in connection with such testing, with no copayment
9 for the test. At the same time, the Department shall require
10 each such inmate to sign a form stating that the inmate has
11 been informed of his or her rights with respect to the testing
12 required to be offered under this subsection (l) and providing
13 the inmate with an opportunity to indicate either that he or
14 she wants to be tested or that he or she does not want to be
15 tested. The Department, in consultation with the Department of
16 Public Health, shall prescribe the contents of the form. The
17 testing provided under this subsection (l) shall consist of an
18 enzyme-linked immunosorbent assay (ELISA) test or any other

1 test approved by the Department of Public Health. If the test
2 result is positive, the Western Blot Assay or more reliable
3 confirmatory test shall be administered."; and
 
4 by replacing lines 25 and 26 on page 9 and lines 1 through 15 on
5 page 10 with the following:
6 "Department also must test offer the committed person the
7 option of being tested, with no copayment, for infection with
8 human immunodeficiency virus (HIV). The Department shall
9 require each committed person to sign a form stating that the
10 committed person has been informed of his or her rights with
11 respect to the testing required to be offered under this
12 subsection (d) and providing the committed person with an
13 opportunity to indicate either that he or she wants to be
14 tested or that he or she does not want to be tested. The
15 Department, in consultation with the Department of Public
16 Health, shall prescribe the contents of the form. The testing
17 provided under this subsection (d) shall consist of an
18 enzyme-linked immunosorbent assay (ELISA) test or any other
19 test approved by the Department of Public Health. If the test
20 result is positive, the Western Blot Assay or more reliable
21 confirmatory test shall be administered. Implementation of
22 this subsection (d) is subject to appropriation.".
