AMENDMENT TO HOUSE BILL 797

2     AMENDMENT NO. ______. Amend House Bill 797, AS AMENDED,
3 with reference to page and line numbers of Senate Amendment No.
4 1 on page 1, by replacing line 5 with "Sections 3-684 and 3-713
5 and by changing Section 3-809 as follows:"; and
 
6 on page 2, by inserting below line 22 the following:
 
7     "(625 ILCS 5/3-713 new)
8     Sec. 3-713. Relief from fines for certain offenses against
9 registration.
10     (a) Except as provided in subsection (b) of this Section,
11 the owner of a motor vehicle, subject to registration under
12 this Chapter, who is charged with a violation of Sections
13 3-401, 3-413(f) and 3-701 of this Code, shall be required to
14 pay any fines for a violation upon conviction.
15     (b) If a person charged with a violation of Sections 3-401,
16 3-413(f), and 3-701 of this Code for a first time provides

1 proof of a current and valid registration sticker dated within
2 30 days of the expiration of the registration for which the
3 citation was issued, that person may, upon presenting
4 acceptable proof of current registration, request and receive
5 relief from the penalties imposed for a violation. Acceptable
6 proof shall include, but not be limited to, proof of payment of
7 all applicable registration fees, as well as delinquent
8 registration renewal fees under Section 3-821.2 of this Code. A
9 person charged with a second or subsequent violation of
10 Sections 3-401, 3-413(f), and 3-701 of this Code or a person
11 who registers a motor vehicle after 30 days of the day from
12 which the person was required by this Code to register a motor
13 vehicle shall not be eligible for relief under this Section.
14     (c) The chief judge of any circuit may designate an officer
15 of the court to review the documentation demonstrating
16 eligibility for relief from fines imposed for a violation of
17 Sections 3-401, 3-413 (f) and 3-701 of this Code as provided in
18 subsection (b) of this Section. The officer of the court, upon
19 confirmation of the violator's compliance with the conditions
20 set forth in this Section, may submit a recommendation for
21 dismissal of the instant citation to the prosecuting
22 authority.".
