AMENDMENT TO HOUSE BILL 39

2     AMENDMENT NO. ______. Amend House Bill 39 on page 1, line
3 23, after the period, by inserting the following: "Criteria
4 applicable to a spousal caregiver shall include, but need not
5 be limited to, (i) a limitation on the total hours of a spousal
6 caregiver's outside employment plus hours of providing care to
7 his or her eligible spouse to ensure that the complete plan of
8 care is delivered to the eligible spouse and (ii) limitations
9 on a spousal caregiver's participation in the demonstration
10 project if the caregiver has a known history of spousal abuse,
11 neglect, or exploitation."; and
 
12 on page 2, line 2, after the period, by inserting the
13 following: "Spousal caregivers shall be paid at the Personal
14 Assistant level of care and pay rate. In those instances in
15 which the eligible spouse requires specialized services (for
16 example, services provided by a certified nursing assistant
17 (CNA), licensed practical nurse (LPN), or registered nurse

1 (RN)) and the spousal caregiver has the corresponding
2 certification or licensure, the spousal caregiver shall be paid
3 the higher rate for the specialized services only. The
4 specialized services the eligible spouse is authorized to
5 receive shall be defined and approved in the services plan.";
6 and
 
7 on page 2, after line 21, by inserting the following:
8         "(11) Monthly in-home monitoring of the health and
9     safety of the eligible spouse.
10         (12) Documentation of the marital relationship for
11     participation in the demonstration project.
12         (13) Assurances that the eligible spouse is capable of
13     communicating his or her needs.
14         (14) Enrollment of an alternative care provider to
15     ensure that there is no disruption of care to the eligible
16     spouse.
17         (15) Assurances that the spousal caregiver is
18     emotionally, physically, and cognitively able to provide
19     the necessary care to the eligible spouse.".
