1     AN ACT concerning local government.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 3. The Downstate Public Transportation Act is
5 amended by adding Section 2-15.3 as follows:
 
6     (30 ILCS 740/2-15.3 new)
7     Sec. 2-15.3. Transit services for disabled individuals.
8 Notwithstanding any law to the contrary, no later than 60 days
9 following the effective date of this amendatory Act of the 95th
10 General Assembly, all fixed route public transportation
11 services provided by, or under grant or purchase of service
12 contract of, any participant shall be provided without charge
13 to all disabled persons who meet the income eligibility
14 limitation set forth in subsection (a-5) of Section 4 of the
15 Senior Citizens and Disabled Persons Property Tax Relief and
16 Pharmaceutical Assistance Act, under such procedures as shall
17 be prescribed by the participant. The Department on Aging shall
18 furnish all information reasonably necessary to determine
19 eligibility, including updated lists of individuals who are
20 eligible for services without charge under this Section.
 
21     Section 5. If and only if the provisions of House Bill 656
22 of the 95th General Assembly become law, the Counties Code is

1 amended by adding Section 6-34000 as follows:
 
2     (55 ILCS 5/6-34000 new)
3     Sec. 6-34000. Report on funds received under the Regional
4 Transportation Authority Act. If the Board of the Regional
5 Transportation Authority adopts an ordinance under Section
6 4.03 of the Regional Transportation Authority Act imposing a
7 retailers' occupation tax and a service occupation tax at the
8 rate of 0.75% in the counties of DuPage, Kane, Lake, McHenry,
9 and Will, then the County Boards of DuPage, Kane, Lake,
10 McHenry, and Will counties shall each report to the General
11 Assembly and the Commission on Government Forecasting and
12 Accountability by March 1 of the year following the adoption of
13 the ordinance and March 1 of each year thereafter. That report
14 shall include the total amounts received by the County under
15 subsection (n) of Section 4.03 of the Regional Transportation
16 Authority Act and the expenditures and obligations of the
17 County using those funds during the previous calendar year.
 
18     Section 10. The Metropolitan Transit Authority Act is
19 amended by adding Section 52 as follows:
 
20     (70 ILCS 3605/52 new)
21     Sec. 52. Transit services for disabled individuals.
22 Notwithstanding any law to the contrary, no later than 60 days
23 following the effective date of this amendatory Act of the 95th

1 General Assembly, all fixed route public transportation
2 services provided by, or under grant or purchase of service
3 contract of, the Board shall be provided without charge to all
4 disabled persons who meet the income eligibility limitation set
5 forth in subsection (a-5) of Section 4 of the Senior Citizens
6 and Disabled Persons Property Tax Relief and Pharmaceutical
7 Assistance Act, under such procedures as shall be prescribed by
8 the Board. The Department on Aging shall furnish all
9 information reasonably necessary to determine eligibility,
10 including updated lists of individuals who are eligible for
11 services without charge under this Section.
 
12     Section 15. The Local Mass Transit District Act is amended
13 by adding Section 8.7 as follows:
 
14     (70 ILCS 3610/8.7 new)
15     Sec. 8.7. Transit services for disabled individuals.
16 Notwithstanding any law to the contrary, no later than 60 days
17 following the effective date of this amendatory Act of the 95th
18 General Assembly, all fixed route public transportation
19 services provided by, or under grant or purchase of service
20 contract of, any District shall be provided without charge to
21 all disabled persons who meet the income eligibility limitation
22 set forth in subsection (a-5) of Section 4 of the Senior
23 Citizens and Disabled Persons Property Tax Relief and
24 Pharmaceutical Assistance Act, under such procedures as shall

1 be prescribed by the District. The Department on Aging shall
2 furnish all information reasonably necessary to determine
3 eligibility, including updated lists of individuals who are
4 eligible for services without charge under this Section.
 
5     Section 20. The Regional Transportation Authority Act is
6 amended by adding Sections 3A.16 and 3B.15 as follows:
 
7     (70 ILCS 3615/3A.16 new)
8     Sec. 3A.16. Transit services for disabled individuals.
9 Notwithstanding any law to the contrary, no later than 60 days
10 following the effective date of this amendatory Act of the 95th
11 General Assembly, all fixed route public transportation
12 services provided by, or under grant or purchase of service
13 contract of, the Suburban Bus Board shall be provided without
14 charge to all disabled persons who meet the income eligibility
15 limitation set forth in subsection (a-5) of Section 4 of the
16 Senior Citizens and Disabled Persons Property Tax Relief and
17 Pharmaceutical Assistance Act, under such procedures as shall
18 be prescribed by the Board. The Department on Aging shall
19 furnish all information reasonably necessary to determine
20 eligibility, including updated lists of individuals who are
21 eligible for services without charge under this Section.

23     Sec. 3B.15. Transit services for disabled individuals.

2 following the effective date of this amendatory Act of the 95th
3 General Assembly, all fixed route public transportation
4 services provided by, or under grant or purchase of service
5 contract of, the Commuter Rail Board shall be provided without
6 charge to all disabled persons who meet the income eligibility
7 limitation set forth in subsection (a-5) of Section 4 of the
8 Senior Citizens and Disabled Persons Property Tax Relief and
9 Pharmaceutical Assistance Act, under such procedures as shall
10 be prescribed by the Board. The Department on Aging shall
11 furnish all information reasonably necessary to determine
12 eligibility, including updated lists of individuals who are
13 eligible for services without charge under this Section.
 
14     Section 99. Effective date. This Act takes effect upon
15 becoming law.
