AMENDMENT TO SENATE BILL 940

2     AMENDMENT NO. ______. Amend Senate Bill 940 on page 3, line
3 8, by replacing "and" with "or"; and
 
4 on page 5, lines 2 and 3, by deleting "as described in clause
5 (3) of this subsection (b),"; and
 
6 on page 5, lines 8 and 9, by replacing "subsections subsection
7 (e) and" with "subsection (e) or"; and
 
8 on page 5, line 10, by replacing "and 18" with "or 18"; and
 
9 on page 5, line 17, by replacing "person" with "patient"; and
 
10 on page 5, line 20, by inserting after "redisclosed" the
11 following:
12 ", except as required by clause (e)(2) of Section 3.1 of the
13 Firearm Owners Identification Card Act,"; and

1 on page 7, by replacing lines 6 through 19 with the following:
2 "treatment. for in-patients and excludes institutions, such as
3 community clinics, which only provide treatment to
4 out-patients.
5         (2) "Patient" shall include only: (i) a person who is
6     an in-patient or resident of any public or private hospital
7     or mental health facility or (ii) a person who is an
8     out-patient or provided services by a public or private
9     hospital or mental health facility whose mental condition
10     is of such a nature that it is manifested by violent,
11     suicidal, threatening, or assaultive behavior or reported
12     behavior, for which there is a reasonable belief by a
13     physician, clinical psychologist, or qualified examiner
14     that the condition poses a clear and present or imminent
15     danger to the patient, any other person or the community
16     meaning the patient's condition poses a clear and present
17     danger in accordance with subsection (f) of Section 8 of
18     the Firearm Owners Identification Card Act. The terms
19     physician, clinical psychologist, and qualified examiner
20     are defined in Sections 1-120, 1-103, and 1-122 of the
21     Mental Health and Developmental Disabilities Code. mean
22     only a person who is an in-patient or resident of any
23     hospital, not an out-patient or client seen solely for
24     periodic consultation.
25         (3) "Mental health facility" is defined by Section
