AMENDMENT TO SENATE BILL 778

2     AMENDMENT NO. ______. Amend Senate Bill 778 on page 58, by
3 inserting after line 22 the following:
 
4     "Section 905. Upon the conveyance of the property described
5 in Section 920 to the State of Illinois, the Director of
6 Natural Resources shall convey to the Toney Watkins Company by
7 quit claim deed all right, title and interest in and to the
8 following described land in Perry County, Illinois.
 
9 All of the South 1/2 of Section 1, except; the NW 1/4 of the SW
10 1/4 of Section 1, the area Northeast of Leopard Road and the
11 area East of Panda Bear Road, The South 1/4 of Section 2, All
12 of Section 11, All of that part of Section 12; West of Panda
13 Bear Road, All of that Part of Section 13; West of Panda Bear
14 Road, except, the SW 1/4, of the SW 1/4, of Section 13. All of
15 Section 14 except; the East 14 acres of the SE 1/4, of the SE
16 1/4, of Section 14, T.6S., R.4W., of the 3rd P.M., Perry

1 County, Illinois and containing approximately 2,000 acres.
 
2 More commonly described as that area of Pyramid State Park
3 North of Perry County Hwy 4 (Pyatt-Cutler Road) and west of
4 Panda Bear Road.
 
5     Section 920. In consideration of the conveyance by the
6 State of the property described in Section 905, the Toney
7 Watkins Company shall convey to the State by quit claim deed
8 all right, title and interest in and to the following described
9 land in Perry County, Illinois.
 
10 Part of Section 21, 22, 23, and 26, all of Section 27, and part
11 of Section 28, 33, and 34, T.6S., R.2W. of the 3rd P.M., Perry
12 County, Illinois and containing approximately 2,000 acres.
 
13     Section 925. Legislative Findings. A determination has
14 been made by the Director of Natural Resources that the
15 properties to be exchanged pursuant to Section 905 and Section
16 920 of this Act are of equal value, size and attributes, and
17 further that development opportunities expected to be
18 facilitated by the exchange will result in a minimum private
19 investment of $100,000,000 and approximately 2,500 jobs.
 
20     Section 930. The transfers of property under Section 905
21 and Section 920 of this Act shall be contingent upon the State

1 of Illinois and the Toney Watkins Company entering into a
2 contract under which the Toney Watkins Company agrees to pay a
3 sum of money to the State of Illinois and perform certain
4 activities regarding the remediation and restoration of the
5 property to be transferred to the State of Illinois.
 
6     Section 940. Upon this Act becoming law, conveyance
7 negotiations shall not be initiated by the Director of Natural
8 Resources or the Director's designee until (i) the Department
9 of Natural Resources is in receipt of a bond in the amount 10%
10 of the appraised value of the property to be conveyed and (ii)
11 the submission of completed applications for any and all
12 assistance being sought from the Department of Commerce and
13 Economic Opportunity, the Illinois Finance Authority, and any
14 other federal, State, or local government agencies.
 
15     Section 950. The Director of Natural Resources shall obtain
16 a certified copy of the portion of this Act containing the
17 title, the enacting clause, the effective date, and the
18 appropriate Section containing the land description of the
19 property to be transferred under Section 905 within 60 days
20 after the effective date of this Act and shall record the
21 certified document in the Recorder's Office in the county in
22 which the land is located.".
