AMENDMENT TO HOUSE BILL 5586

2     AMENDMENT NO. ______. Amend House Bill 5586 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Counties Code is amended by adding Section
5 3-5047 as follows:
 
6     (55 ILCS 5/3-5047 new)
7     Sec. 3-5047. Removal of personal information. Upon request
8 by any person, the recorder shall redact or remove that
9 person's social security number, employer taxpayer
10 identification number, drivers license number, State
11 identification number, passport number, checking account
12 number, savings account number, credit card number, debit card
13 number, or personal identification (PIN) code from any internet
14 website maintained by the recorder or used by the recorder to
15 display public records. The request must be made in writing and
16 delivered by mail, facsimile, electronic transmission, or in

1 person to the office of the recorder. The request must specify
2 the personal information to be redacted and identify the
3 document that contains the personal information.
4     Within 12 months after the effective date of this
5 amendatory Act of the 95th General Assembly all county
6 recorders that publicly display records on an Internet website
7 must submit a written policy, including a timeline, to their
8 respective county boards providing for the redaction of social
9 security numbers from all records publicly displayed on the
10 website. Any county recorder that launches a website on or
11 after the effective date of this amendatory Act of the 95th
12 General Assembly shall develop and implement a policy providing
13 for the removal of all social security numbers from all records
14 prior to the public display of those records on the website,
15 and must file a copy of the policy with the county board of
16 that county. Policies pertaining to the removal of social
17 security numbers from records to be posted on the internet
18 shall be made available to all employees of a county recorder.
19     No person or entity shall include an individual's social
20 security number in a document that is prepared and presented
21 for recording with a county recorder. This Section shall not
22 apply to (i) State or federal tax liens, certified copies of
23 death certificates, or other documents required by law to
24 contain personal identifying information or (ii) documents
25 that were executed by an individual prior to the effective date
26 of this amendatory Act of the 95th General Assembly.

1     County recorders shall not be liable for any claims arising
2 from unintentional or inadvertent violations of this Section.
 
3     Section 10. The State Mandates Act is amended by adding
4 Section 8.32 as follows:
 
5     (30 ILCS 805/8.32 new)
6     Sec. 8.32. Exempt mandate. Notwithstanding Sections 6 and 8
7 of this Act, no reimbursement by the State is required for the
8 implementation of any mandate created by this amendatory Act of
9 the 95th General Assembly.".
