AMENDMENT TO HOUSE BILL 5037

2     AMENDMENT NO. ______. Amend House Bill 5037 on page 2, by
3 replacing lines 7 through 13 with the following:
4         "(2) "Owner" means any unit owner or owner of record of
5     the condominium property.
6         (3) "Other party in interest" means any mortgagee of
7     record, lien holder of record, judgment creditor, tax
8     purchaser, or other party of record, other than the owner,
9     having legal or equitable title or other interest in the
10     distressed condominium property or in a unit of the
11     property.
12         (4) "Municipality" means a city, village, or"; and
 
13 on page 2, by replacing lines 21 through 24 with the following:
14 "and shall request the relief available under this Section. All
15 owners shall be named as defendants in the petition or
16 complaint and summons shall be issued and service shall be had
17 as in other civil cases. All known other parties in interest

1 shall be provided written notice and a copy of the petition or
2 complaint either by United States certified mail, return
3 receipt requested, within 30 days of the issuance of the
4 summons or by personal service of the complaint. The hearing";
5 and
 
6 on page 4, line 1, by inserting immediately after "may" the
7 following:
8 "upon a motion filed, notice given to all owners and other
9 parties in interest as provided in subsection (b) and those
10 parties having an opportunity to be heard,"; and
 
11 on page 4, line 4, by deleting "without their consent".
