SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/25-1.1

    Amends the Criminal Code of 1961 relating to the offense of unlawful contact with streetgang members. Provides that a person convicted of a third or subsequent violation of the offense is guilty of a Class 4 felony.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by changing
5 Section 25-1.1 as follows:
 
6     (720 ILCS 5/25-1.1)
7     Sec. 25-1.1. Unlawful contact with streetgang members.
8     (a) A person commits the offense of unlawful contact with
9 streetgang members when:
10         (1) He or she knowingly has direct or indirect contact
11     with a streetgang member as defined in Section 10 of the
12     Illinois Streetgang Terrorism Omnibus Prevention Act after
13     having been sentenced to probation, conditional discharge,
14     or supervision for a criminal offense with a condition of
15     such sentence being to refrain from direct or indirect
16     contact with a streetgang member or members;
17         (2) He or she knowingly has direct or indirect contact
18     with a streetgang member as defined in Section 10 of the
19     Illinois Streetgang Terrorism Omnibus Prevention Act after
20     having been released on bond for any criminal offense with
21     a condition of such bond being to refrain from direct or
22     indirect contact with a streetgang member or members;
23         (3) He or she knowingly has direct or indirect contact

1     with a streetgang member as defined in Section 10 of the
2     Illinois Streetgang Terrorism Omnibus Prevention Act after
3     having been ordered by a judge in any non-criminal
4     proceeding to refrain from direct or indirect contact with
5     a streetgang member or members; or
6         (4) He or she knowingly has direct or indirect contact
7     with a streetgang member as defined in Section 10 of the
8     Streetgang Terrorism Omnibus Prevention Act after having
9     been released from the Illinois Department of Corrections
10     on a condition of parole or mandatory supervised release
11     that he or she refrain from direct or indirect contact with
12     a streetgang member or members.
13     (b) Unlawful contact with streetgang members is a Class A
14 misdemeanor. A person convicted of a third or subsequent
15 violation of this Section is guilty of a Class 4 felony.
16     (c) This Section does not apply to a person when the only
17 streetgang member or members he or she is with is a family or
18 household member or members as defined in paragraph (3) of
19 Section 112A-3 of the Code of Criminal Procedure of 1963 and
20 the streetgang members are not engaged in any streetgang
21 related activity.
