AMENDMENT TO HOUSE BILL 4451

2     AMENDMENT NO. ______. Amend House Bill 4451 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Illinois Lottery Law is amended by adding
5 Sections 7.9 and 27.5 as follows:
 
6     (20 ILCS 1605/7.9 new)
7     Sec. 7.9. Study of demographic data.
8     (a) At least once every 2 years, the Department shall
9 employ an independent firm that is experienced in demographic
10 analysis to conduct a demographic study of lottery players in
11 the State. The study must include the income, age, sex, race,
12 education, and frequency of participation of the players.
13     (b) The Director shall report the results of the
14 demographic study under this Section to the Governor and to the
15 General Assembly before the convening of the regular
16 legislative session that immediately follows the completion of

1 the study.
 
2     (20 ILCS 1605/27.5 new)
3     Sec. 27.5. No rulemaking authority. Notwithstanding any
4 other provision of this Act or any other rulemaking authority
5 that may exist, on and after the effective date of this
6 amendatory Act of the 95th General Assembly, neither the
7 Governor nor any agency or agency head under the jurisdiction
8 of the Governor has any authority to make or promulgate rules
9 to implement or enforce the provisions of this Act. If,
10 however, the Governor believes that rules are necessary to
11 implement or enforce the provisions of this Act, the Governor
12 may suggest rules to the General Assembly by filing them with
13 the Clerk of the House and Secretary of the Senate and by
14 requesting that the General Assembly authorize such rulemaking
15 by law, enact those suggested rules into law, or take any other
16 appropriate action in the General Assembly's discretion.
17 Nothing contained in this Act shall be interpreted to grant
18 rulemaking authority under any other Illinois statute where
19 such authority is not otherwise explicitly given. For the
20 purposes of this Act, "rules" is given the meaning contained in
21 Section 1-70 of the Illinois Administrative Procedure Act, and
22 "agency" and "agency head" are given the meanings contained in
23 Sections 1-20 and 1-25 of the Illinois Administrative Procedure
24 Act to the extent that such definitions apply to agencies or
25 agency heads under the jurisdiction of the Governor.

1     Section 99. Effective date. This Act takes effect upon
2 becoming law.".
