1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Elevator Safety and Regulation Act is
5 amended by adding Section 97 as follows:
 
6     (225 ILCS 312/97 new)
7     Sec. 97. Notice of elevator malfunction. Any elevator that
8 has malfunctioned in a manner that has led to the dispatch of a
9 fire department for rescue must be marked by that rescuing fire
10 department with an identifying sticker, which shall be placed
11 conspicuously within the malfunctioning elevator and shall
12 state the name of the dispatching fire department, the date on
13 which the fire department was dispatched, and the fact that the
14 elevator experienced a malfunction on that dispatching date. A
15 sticker placed within a malfunctioning elevator may be removed
16 only by an elevator mechanic licensed under this Act.
17 Notwithstanding any other rulemaking authority that may exist,
18 neither the Governor nor any agency or agency head under the
19 jurisdiction of the Governor has any authority to make or
20 promulgate rules to implement or enforce the provisions of this
21 amendatory Act of the 95th General Assembly. If, however, the
22 Governor believes that rules are necessary to implement or
23 enforce the provisions of this amendatory Act of the 95th

1 General Assembly, the Governor may suggest rules to the General
2 Assembly by filing them with the Clerk of the House and the
3 Secretary of the Senate and by requesting that the General
4 Assembly authorize such rulemaking by law, enact those
5 suggested rules into law, or take any other appropriate action
6 in the General Assembly's discretion. Nothing contained in this
7 amendatory Act of the 95th General Assembly shall be
8 interpreted to grant rulemaking authority under any other
9 Illinois statute where such authority is not otherwise
10 explicitly given. For the purposes of this amendatory Act of
11 the 95th General Assembly, "rules" is given the meaning
12 contained in Section 1-70 of the Illinois Administrative
13 Procedure Act, and "agency" and "agency head" are given the
14 meanings contained in Sections 1-20 and 1-25 of the Illinois
15 Administrative Procedure Act to the extent that such
16 definitions apply to agencies or agency heads under the
17 jurisdiction of the Governor.
