| AN ACT concerning education.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The School Code is amended by changing Section | 5 |
| 11E-10 as follows: | 6 |
| (105 ILCS 5/11E-10) | 7 |
| Sec. 11E-10. Definitions. In this Article: | 8 |
| "Affected district" means any
any school district with | 9 |
| territory included in a petition for reorganization under this | 10 |
| Article that encompasses (i) 25% or more of the total land area | 11 |
| of the district, (ii) more than 8% of the student enrollment of | 12 |
| the district, or (iii) more than 8% of the equalized assessed | 13 |
| valuation of the district. | 14 |
| "Combined high school - unit district" means a school | 15 |
| district resulting from the combination of a high school | 16 |
| district and a unit district. | 17 |
| "Combined school district" means any district resulting | 18 |
| from the combination of 2 or more entire elementary districts, | 19 |
| 2 or more entire high school districts, or 2 or more entire | 20 |
| unit districts. | 21 |
| "Dual district" means a high school district and all of its | 22 |
| feeder elementary districts collectively. | 23 |
| "Elementary district" means a school district organized |

| and established for purposes of providing instruction up to and | 2 |
| including grade 8. "Elementary district" includes common | 3 |
| elementary school districts, consolidated elementary school | 4 |
| districts, community consolidated school districts, combined | 5 |
| elementary districts, and charter elementary districts. | 6 |
| "Elementary purposes" means the purposes of providing | 7 |
| instruction up to and including grade 8. | 8 |
| "High school district" means a school district organized | 9 |
| and established for purposes of providing instruction in grades | 10 |
| 9 through 12. "High school district" includes charter high | 11 |
| school districts, township high school districts, consolidated | 12 |
| high school districts, community high school districts, and | 13 |
| non-high school districts. | 14 |
| "High school purposes" means the purposes of providing | 15 |
| instruction in grades nine through 12. | 16 |
| "High school - unit conversion" means a school district | 17 |
| conversion authorized under subsection (a) of Section 11E-15 of | 18 |
| this Code.

| "K through 12 purposes" means the purposes of providing | 20 |
| instruction up to and including grade 12.

| "Multi-unit conversion" means the formation of a combined | 22 |
| high school - unit district and one or more new elementary | 23 |
| districts as authorized under subsection (b) of Section 11E-30 | 24 |
| of this Code.
| 25 |
| "Optional elementary unit district" means a unit district | 26 |
| resulting from the combination of a high school district and |

| the combination of any one or more elementary districts | 2 |
| electing to organize as an optional elementary unit district. | 3 |
| "Partial elementary unit district" means either a combined | 4 |
| high school - unit district or an optional elementary unit | 5 |
| district. | 6 |
| "School board" means either a board of education or a board | 7 |
| of school directors. | 8 |
| "School district conversion" means a high school - unit | 9 |
| conversion or a unit to dual conversion. | 10 |
| "School needs" means the needs of the proposed school | 11 |
| district and any districts in the area adjacent thereto in | 12 |
| relation to, without limitation, providing a full range of high | 13 |
| quality educational and extracurricular programs, maintaining | 14 |
| a full complement of professional staff to deliver optimal | 15 |
| educational services, meeting the program and staff needs of | 16 |
| all students, including students with disabilities and | 17 |
| students in career and technical education courses, maximizing | 18 |
| community involvement in school governance, operating on an | 19 |
| economically efficient basis, and maintaining a sufficient | 20 |
| local tax base. | 21 |
| "Substantially coterminous" means that a high school | 22 |
| district and one or more elementary districts share the same | 23 |
| boundaries or share the same boundaries except for territory | 24 |
| encompassing, for a particular district, (i) less than 25% of | 25 |
| the land area of the district, (ii) less than 8% of the student | 26 |
| enrollment of the district, and (iii) less than 8% of the |

| equalized assessed valuation of the district. | 2 |
| "Unit district" means a school district organized and | 3 |
| established for purposes of providing instruction up to and | 4 |
| including grade 12. "Unit district" includes charter (K through | 5 |
| 12) districts, community unit districts, community | 6 |
| consolidated unit districts, other districts that, prior to the | 7 |
| adoption of the community consolidated unit district and | 8 |
| community unit district, authorizing legislation had expanded | 9 |
| to provide instruction through the 12th grade (commonly | 10 |
| referred to as "Old Type" unit districts), and partial | 11 |
| elementary unit districts organized pursuant to the provisions | 12 |
| of this Article.
| 13 |
| "Unit to dual conversion" means a school district | 14 |
| conversion authorized under subsection (b) of Section 11E-15 of | 15 |
| this Code.
