Amends the Wildlife Code. Provides that the Illinois Conservation Foundation shall invest the moneys of the State Pheasant Fund (now the Department of Natural Resources administers the Fund). Effective July 1, 2007.

| AN ACT concerning wildlife.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Wildlife Code is amended by changing Section | 5 |
| 1.31 as follows:
| 6 |
| (520 ILCS 5/1.31) (from Ch. 61, par. 1.31)

| Sec. 1.31. Pheasant Fund. There is created in the
State | 8 |
| Treasury the State
Pheasant Fund.
All interest earned on monies | 9 |
| in this Fund shall remain in the
fund.
| 10 |
| (a) Thirty percent of the money collected from the sale of | 11 |
| State Habitat
Stamps, and all interest earned, gifts, | 12 |
| donations, grants, and bequests of
money for the
conservation | 13 |
| of wild pheasants shall be deposited
into the State Pheasant | 14 |
| Fund for
appropriation to the Illinois Conservation | 15 |
| Foundation. The Illinois Conservation Foundation shall invest | 16 |
| the moneys in the Fund to provide
Department for the following | 17 |
| purposes :
| 18 |
| (1) 50% of funds derived from the sale of State Habitat
| 19 |
| Stamps and deposited into the State Pheasant Fund, and all | 20 |
| interest earned, gifts,
donations, grants and bequests of
| 21 |
| money for the conservation of wild pheasants shall be used | 22 |
| by the
Department for the conservation of wild pheasants.

| Before allocating any funds under the provisions of this |

| subsection, the
Department shall submit plans for use of | 2 |
| the funds to the State Pheasant Committee for its approval. | 3 |
| Pheasant conservation projects may
include land | 4 |
| acquisition, pheasant habitat improvement on public or | 5 |
| private
land, pheasant research, and education of the | 6 |
| public regarding pheasants
and pheasant hunting. None of | 7 |
| the monies spent
under this Section shall be used for | 8 |
| administrative expenses.
| 9 |
| (2) 50% of funds derived from the sale of
State Habitat | 10 |
| Stamps and deposited into the Pheasant
Fund shall be | 11 |
| allocated
by the Department to appropriate
not-for-profit | 12 |
| organizations for the purpose of wild pheasant | 13 |
| conservation.
Before allocating
any funds under the | 14 |
| provisions of this paragraph (2), the Department
shall | 15 |
| submit the organizations' plans for use of the funds to the | 16 |
| State
Pheasant Committee for its approval. By December 31 | 17 |
| of each year,
any organization receiving funds under this | 18 |
| paragraph (2) shall report
to the Department and the | 19 |
| Committee on its use of those funds.
Pheasant conservation | 20 |
| projects may include land acquisition, pheasant
habitat | 21 |
| improvement on public or private land, pheasant research, | 22 |
| or
education of the public regarding pheasants and pheasant | 23 |
| hunting.
| 24 |
| (b) The State Pheasant Committee is created and
shall | 25 |
| consist of:
(1) the Chief of the Wildlife
Resources Division or | 26 |
| his designee, (2) the Chief of the Land Management
Division or |

| his designee, (3) one representative appointed by the
Director | 2 |
| who is from a nonprofit institution, corporation, or university
| 3 |
| within the State and is actively engaged in wildlife research | 4 |
| pertaining to
game birds, especially pheasants, (4) the Chief | 5 |
| of the Technical Services
Division or his designee, and (5) 2 | 6 |
| or
more representatives from statewide pheasant organizations,
| 7 |
| appointed by the Director. The Committee shall review and | 8 |
| recommend all
allocation of funds from the State Pheasant Fund.
| 9 |
| (c) At the end of each license accounting period, if 30% of | 10 |
| the money
collected from the sale of State Habitat Stamps and | 11 |
| deposited into the
State Pheasant Fund is less than $500,000, | 12 |
| the Director shall request a
transfer and the State Comptroller
| 13 |
| and State Treasurer shall transfer from the Illinois Habitat | 14 |
| Fund to the
State Pheasant Fund the amount
necessary to bring | 15 |
| the total deposited into the State Pheasant Fund to $500,000.

| Section 99. Effective date. This Act takes effect July 1, | 18 |
| 2007.
