SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/12-16.3 new

    Amends the Criminal Code of 1961. Creates the offense of sexual battery. Provides that a person commits the offense when he or she intentionally or knowingly without legal justification makes physical contact with the intimate body parts of a victim who was 17 years of age or older at the time of the commission of the offense, without that person's consent. Defines intimate body parts. Provides that a violation is a Class A misdemeanor. Effective immediately.

1     AN ACT concerning criminal law.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Criminal Code of 1961 is amended by adding
5 Section 12-16.3 as follows:
 
6     (720 ILCS 5/12-16.3 new)
7     Sec. 12-16.3. Sexual battery.
8     (a) A person commits the offense of sexual battery when he
9 or she intentionally or knowingly without legal justification
10 makes physical contact with the intimate body parts of a victim
11 who was 17 years of age or older at the time of the commission
12 of the offense, without that person's consent.
13     (b) For purposes of this Section, "intimate body parts"
14 includes the primary genital area, anus, groin, inner thighs,
15 buttocks, or breasts of a male or female.
16     (c) Sentence. Sexual battery is a Class A misdemeanor.
 
17     Section 99. Effective date. This Act takes effect upon
18 becoming law.
