Amends the State Universities Article of the Illinois Pension Code. Provides that an employee is entitled to receive service credit for up to 2 years (now up to one year) of unused sick leave. Effective immediately.

| AN ACT concerning public employee benefits.

| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Illinois Pension Code is amended by changing | 5 |
| Section 15-113.4 as follows:
| 6 |
| (40 ILCS 5/15-113.4) (from Ch. 108 1/2, par. 15-113.4)

| Sec. 15-113.4. Service for unused sick leave. "Service for | 8 |
| unused
sick leave": A participant who is an employee under this | 9 |
| System or one of
the other systems subject to Article 20 of | 10 |
| this Code within 60 days
immediately preceding the date on | 11 |
| which his or her retirement annuity
begins, is entitled to | 12 |
| credit for service for that portion of unused sick
leave earned | 13 |
| in the course of employment with an employer and credited on
| 14 |
| the date of termination of employment by an employer for which | 15 |
| payment is
not received, in accordance with the following | 16 |
| schedule: 30 through 90
full calendar days and 20 through 59 | 17 |
| full work days of unused sick leave,
1/4 of a year of service; | 18 |
| 91 through 180 full calendar days and 60 through
119 full work | 19 |
| days, 1/2 of a year of service; 181 through 270 full calendar
| 20 |
| days and 120 through 179 full work days, 3/4 of a year of | 21 |
| service; 271
through 360 full calendar days and 180 through 240 | 22 |
| full work days, one year
of service ; 361 through 450
full | 23 |
| calendar days and 241 through 300 full work days of unused sick |

| Only uncompensated, unused sick leave earned in accordance with | 7 |
| an
employer's sick leave accrual policy generally applicable to | 8 |
| employees or a
class of employees shall be taken into account | 9 |
| in calculating service credit
under this Section. Any | 10 |
| uncompensated, unused sick leave granted by an
employer to | 11 |
| facilitate the hiring, retirement, termination, or other | 12 |
| special
circumstances of an employee shall not be taken into | 13 |
| account in calculating
service credit under this Section.
If a | 14 |
| participant transfers from one employer to another, the
unused | 15 |
| sick leave credited by the previous employer shall be | 16 |
| considered in
determining service to be credited under this | 17 |
| Section, even if the
participant terminated service prior to | 18 |
| the effective date of P.A. 86-272
(August 23, 1989); if | 19 |
| necessary, the retirement annuity shall be
recalculated to | 20 |
| reflect such sick leave credit. Each employer shall
certify to | 21 |
| the board the number of days of unused sick leave accrued to | 22 |
| the
participant's credit on the date that the participant's | 23 |
| status as an
employee terminated. This period of unused sick | 24 |
| leave shall not be
considered in determining the date the | 25 |
| retirement annuity begins.

| Section 99. Effective date. This Act takes effect upon | 2 |
| becoming law.
