1     AN ACT concerning regulation.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Structural Pest Control Act is amended by
5 changing Section 10.2 as follows:
 
6     (225 ILCS 235/10.2)  (from Ch. 111 1/2, par. 2210.2)
7     (Section scheduled to be repealed on January 1, 2008)
8     Sec. 10.2. Integrated pest management guidelines;
9 notification; training of designated persons; request for
10 copies.
11     (a) The Department shall prepare guidelines for an
12 integrated pest management program for structural pest control
13 practices at school buildings and other school facilities and
14 day care centers. Such guidelines shall be made available to
15 schools, day care centers and the public upon request.
16     (b) When economically feasible, each school and day care
17 center is required to develop and implement adopt an integrated
18 pest management program that incorporates the guidelines
19 developed by the Department. Each school and day care center
20 must notify the Department, within one year after the effective
21 date of this amendatory Act of the 95th General Assembly and
22 every 5 years thereafter, on forms provided by the Department
23 that the school or day care center has developed and is

1 implementing an integrated pest management program If adopting
2 an integrated pest management program would not be economically
3 feasible because it would result in an increase in the school's
4 or day care center's pest control cost, the school district or
5 day care center must provide written notification to the
6 Department. The notification must include projected pest
7 control costs for the term of the pest control program and
8 projected costs for implementing integrated pest management
9 for that same time period. The Department shall make this
10 notification available to the general public upon request. In
11 implementing an integrated pest management program, a school or
12 day care center must assign a employee should be designated
13 person to assume responsibility for the oversight of pest
14 management practices in that school or day care center and for
15 recordkeeping requirements.
16     (b-1) If adopting an integrated pest management program is
17 not economically feasible because such adoption would result in
18 an increase in the pest control costs of the school or day care
19 center, the school or day care center must provide, within one
20 year after the effective date of this amendatory Act of the
21 95th General Assembly and every 5 years thereafter, written
22 notification to the Department, on forms provided by the
23 Department, that the development and implementation of an
24 integrated pest management program is not economically
25 feasible. The notification must include projected pest control
26 costs for the term of the pest control program and projected

1 costs for implementing an integrated pest management program
2 for that same time period.
3     (b-2) Each school or day care center that provides written
4 notification to the Department that the adoption of an
5 integrated pest management program is not economically
6 feasible pursuant to subsection (b-1) of this Section must have
7 its designated person attend a training course on integrated
8 pest management within one year after the effective date of
9 this amendatory Act of the 95th General Assembly, and every 5
10 years thereafter until an integrated pest management program is
11 developed and implemented in the school or day care center. The
12 training course shall be approved by the Department in
13 accordance with the minimum standards established by the
14 Department under this Act.
15     (b-3) Each school and day care center shall ensure that all
16 parents, guardians, and employees are notified at least once
17 each school year that the notification requirements
18 established by this Section have been met. The school and day
19 care center shall keep copies of all notifications required by
20 this Section and any written integrated pest management program
21 plan developed in accordance with this Section and make these
22 copies available for public inspection at the school or day
23 care center.
24     (c) The Structural Pest Control Advisory Council shall
25 assist the Department in developing the guidelines for
26 integrated pest management programs. In developing the

1 guidelines, the Council shall consult with individuals
2 knowledgeable in the area of integrated pest management.
3     (d) The Department, with the assistance of the Cooperative
4 Extension Service and other relevant agencies, may prepare a
5 training program for school or day care center pest control
6 specialists.
7     (e) The Department may request copies of a school's or day
8 care center's integrated pest management program plan and
9 notification required by this Act and offer assistance and
10 training to schools and day care centers on integrated pest
11 management programs.
12     (f) The requirements of this Section are subject to
13 appropriation to the Department for the implementation of
14 integrated pest management programs.

16     Section 99. Effective date. This Act takes effect upon
17 becoming law.
