SYNOPSIS AS INTRODUCED:

    Amends the Illinois Vehicle Code. Provides for the issuance of Iraqi Freedom license plates at an additional initial charge of $40 and an additional renewal charge of $27 with eligibility requirements to be determined by the Secretary of State. Provides that $15 of the initial charge and $2 of the renewal charge shall be paid into the Secretary of State Special License Plate Fund and $25 of the initial charge and $25 of the renewal charge shall be paid into the Illinois Veterans Assistance Fund. Amends the Illinois Lottery Law. Provides that the moneys deposited into the Illinois Veterans Assistance Fund from the sale of Iraqi Freedom license plates may, subject to appropriation, be used by the Department of Veterans' Affairs to provide grants to assist in the financial and educational support of minor and dependent children of veterans who died or were disabled in the line of duty.

1     AN ACT concerning vehicles.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Illinois Lottery Law is amended by changing
5 Section 21.6 as follows:
 
6     (20 ILCS 1605/21.6)
7     Sec. 21.6. Scratch-off for Illinois veterans.
8     (a) The Department shall offer a special instant
9 scratch-off game for the benefit of Illinois veterans. The game
10 shall commence on January 1, 2006 or as soon thereafter, at the
11 discretion of the Director, as is reasonably practical. The
12 operation of the game shall be governed by this Act and any
13 rules adopted by the Department. If any provision of this
14 Section is inconsistent with any other provision of this Act,
15 then this Section governs.
16     (b) The Illinois Veterans Assistance Fund is created as a
17 special fund in the State treasury. The net revenue from the
18 Illinois veterans scratch-off game shall be deposited into the
19 Fund for appropriation by the General Assembly solely to the
20 Department of Veterans Affairs for making grants, funding
21 additional services, or conducting additional research
22 projects relating to:
23         (i) veterans' post traumatic stress disorder;
24         (ii) veterans' homelessness;
25         (iii) the health insurance costs of veterans;
26         (iv) veterans' disability benefits, including but not
27     limited to, disability benefits provided by veterans
28     service organizations and veterans assistance commissions
29     or centers; and
30         (v) the long-term care of veterans.
31     Moneys collected from the special instant scratch-off game
32 shall be used only as a supplemental financial resource and

1 shall not supplant existing moneys that the Department of
2 Veterans Affairs may currently expend for the purposes set
3 forth in items (i-v).
4     Moneys received for the purposes of this subsection (b)
5 Section, including, without limitation, net revenue from the
6 special instant scratch-off game and from gifts, grants, and
7 awards from any public or private entity, must be deposited
8 into the Fund. Any interest earned on moneys in the Fund must
9 be deposited into the Fund.
10     For purposes of this subsection (b), "net revenue" means
11 the total amount for which tickets have been sold less the sum
12 of the amount paid out in the prizes and the actual
13 administrative expenses of the Department solely related to the
14 scratch-off game under this Section.
15     (b-5) The moneys deposited into the Illinois Veterans
16 Assistance Fund from the sale of Iraqi Freedom license plates
17 as authorized by Section 3-664 of the Illinois Vehicle Code
18 may, subject to appropriation, be used by the Department of
19 Veterans' Affairs to provide grants to assist in the financial
20 and educational support of minor and dependent children of
21 veterans who died or were disabled in the line of duty.
22     (c) During the time that tickets are sold for the Illinois
23 veterans scratch-off game, the Department shall not
24 unreasonably diminish the efforts devoted to marketing any
25 other instant scratch-off lottery game.
26     (d) The Department may adopt any rules necessary to
27 implement and administer the provisions of this Section.

29     Section 10. The Illinois Vehicle Code is amended by adding
30 Section 3-664 as follows:

32     Sec. 3-664. Iraqi Freedom license plates.
33     (a) In addition to any other special license plate, the
34 Secretary, upon receipt of all applicable fees and applications

1 made in the form prescribed by the Secretary of State, may
2 issue special registration plates designated as Iraqi Freedom
3 license plates to residents of Illinois who meet eligibility
4 requirements prescribed by the Secretary of State. The special
5 plate issued under this Section shall be affixed only to
6 passenger vehicles of the first division, motorcycles, motor
7 vehicles of the second division weighing not more than 8,000
8 pounds, and recreational vehicles as defined by Section 1-169
9 of this Code. Plates issued under this Section shall expire
10 according to the staggered multi-year procedure established by
11 Section 3-414.1 of this Code.
12     (b) The design, color, and format of the plates shall be
13 wholly within the discretion of the Secretary of State, except
14 that the words "Iraqi Freedom" shall appear on the plates. The
15 Secretary may, in his or her discretion, allow the plates to be
16 issued as vanity or personalized plates in accordance with
17 Section 3-405.1 of this Code. The plates are not required to
18 designate "Land Of Lincoln", as prescribed in subsection (b) of
19 Section 3-412 of this Code. The Secretary shall prescribe the
20 eligibility requirements and, in his or her discretion, shall
21 approve and prescribe stickers or decals as provided under
22 Section 3-412.
23     (c) An applicant shall be charged a $40 fee for original
24 issuance in addition to the applicable registration fee. Of
25 this additional fee, $15 shall be deposited into the Secretary
26 of State Special License Plate Fund and $25 shall be deposited
27 into the Illinois Veterans Assistance Fund. For each
28 registration renewal period, a $27 fee, in addition to the
29 appropriate registration fee, shall be charged. Of this
30 additional fee, $2 shall be deposited into the Secretary of
31 State Special License Plate Fund and $25 shall be deposited
32 into the Illinois Veterans Assistance Fund.
