AMENDMENT TO SENATE BILL 297

2     AMENDMENT NO. ______. Amend Senate Bill 297 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The School Code is amended by changing Section
5 27-24.4 as follows:
 
6     (105 ILCS 5/27-24.4)  (from Ch. 122, par. 27-24.4)
7     Sec. 27-24.4. Reimbursement amount. Each school district
8 shall be entitled to reimbursement, for each pupil, excluding
9 each resident of the district over age 55, who finishes either
10 the classroom instruction part or the practice driving part of
11 a driver education course that meets the minimum requirements
12 of this Act. However, if a school district has adopted a policy
13 to permit proficiency examinations for the practice driving
14 part of the driver education course as provided under Section
15 27-24.3, then the school district is entitled to only one-half
16 of the reimbursement amount for the practice driving part for
17 each pupil who has passed the proficiency examination, and the
18 State Board of Education shall adjust the reimbursement formula
19 accordingly. Reimbursement under this Act Such reimbursement
20 is payable from the Drivers Education Fund in the State
21 treasury.
22     Each year all funds appropriated from the Driver Education
23 Fund to the State Board of Education, with the exception of
24 those funds necessary for administrative purposes of the State

1 Board of Education, shall be distributed to school districts by
2 the State Board of Education for reimbursement of claims from
3 the previous school year.
4     The base reimbursement amount shall be calculated by the
5 State Board by dividing the total amount appropriated for
6 distribution by the total of: (a) the number of students,
7 excluding residents of the district over age 55, who have
8 completed the classroom instruction part for whom valid claims
9 have been made times 0.2; plus (b) the number of students,
10 excluding residents of the district over age 55, who have
11 completed the practice driving instruction part for whom valid
12 claims have been made times 0.8.
13     The amount of reimbursement to be distributed on each claim
14 shall be 0.2 times the base reimbursement amount for each
15 validly claimed student, excluding residents of the district
16 over age 55, who has completed the classroom instruction part,
17 plus 0.8 times the base reimbursement amount for each validly
18 claimed student, excluding residents of the district over age
19 55, who has completed the practice driving instruction part. In
20 no case, however, shall the amount of reimbursement made on
21 account of any student exceed the per pupil cost to the
22 district of the classroom instruction part and the practice
23 driving instruction part combined. The school district which is
24 the residence of a pupil who attends a nonpublic school in
25 another district that has furnished the driver education course
26 shall reimburse the district offering the course, the
27 difference between the actual per capita cost of giving the
28 course the previous school year and the amount reimbursed by
29 the State.
30     By April 1 the nonpublic school shall notify the district
31 offering the course of the names and district numbers of the
32 nonresident students desiring to take such course the next
33 school year. The district offering such course shall notify the
34 district of residence of those students affected by April 15.

1 The school district furnishing the course may claim the
2 nonresident pupil for the purpose of making a claim for State
3 reimbursement under this Act.
