SYNOPSIS AS INTRODUCED:

410 ILCS 45/8.3 new

    Amend the Lead Poisoning Prevention Act. Establishes the CLEAN-WIN program. Provides that the Department of Public Health must reimburse eligible owners of dwellings for replacing windows in living units deemed lead hazards by the Department. Requires the Department to appropriate funds for the program and to adopt rules to implement the program and to establish criteria for eligibility. Effective immediately.

1     AN ACT concerning health.
 
2     Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
 
4     Section 5. The Lead Poisoning Prevention Act is amended by
5 changing Section 7.2 and by adding Section 8.3 as follows:
 
6     (410 ILCS 45/7.2)  (from Ch. 111 1/2, par. 1307.2)
7     Sec. 7.2. Laboratory fees for blood lead screening; Lead
8 Poisoning Fund.
9     (a) The Department may establish fees according to a
10 reasonable fee structure to cover the cost of providing a
11 testing service for laboratory analysis of blood lead tests and
12 any necessary follow-up. Fees collected from the Department's
13 testing service shall be placed in a special fund in the State
14 treasury known as the Lead Poisoning Screening, Prevention, and
15 Abatement Fund. Other State and federal funds for expenses
16 related to lead poisoning screening, follow-up, treatment, and
17 abatement programs may also be placed in the Fund. Moneys shall
18 be appropriated from the Fund to the Department of Public
19 Health solely for the purposes of providing lead screening,
20 follow-up, and treatment programs and for costs incurred under
21 Section 8.3 of this Act.
22     (b) Any delegate agency may establish fees, according to a
23 reasonable fee structure, to cover the costs of drawing blood
24 for blood lead screening and any necessary follow-up.

3     (c) The Department shall adopt rules to implement this
4 Section and to establish eligibility criteria.
 
5     Section 99. Effective date. This Act takes effect upon
6 becoming law.
