AMENDMENT TO HOUSE BILL 4370

2     AMENDMENT NO. ______. Amend House Bill 4370 by replacing
3 everything after the enacting clause with the following:
 
4     "Section 5. The Ambulatory Surgical Treatment Center Act is
5 amended by adding Section 6.7 as follows:
 
6     (210 ILCS 5/6.7 new)
7     Sec. 6.7. Registered nurse administration of limited
8 levels of sedation or analgesia.
9     (a) Nothing in this Act precludes a registered nurse from
10 administering medications for the delivery of local or minimal
11 sedation ordered by a physician licensed to practice medicine
12 in all its branches, podiatrist, or dentist.
13     (b) If the ASTC policy allows the registered nurse to
14 deliver moderate sedation ordered by a physician licensed to
15 practice medicine in all its branches, podiatrist, or dentist,
16 the following are required:
17         (1) The registered nurse must be under the supervision
18     of a physician licensed to practice medicine in all its
19     branches, podiatrist, or dentist during the delivery or
20     monitoring of moderate sedation and have no other
21     responsibilities during the procedure.
22         (2) The registered nurse must maintain current
23     Advanced Cardiac Life Support certification or Pediatric
24     Advanced Life Support certification as appropriate to the

1     age of the patient.
2         (3) The supervising physician licensed to practice
3     medicine in all its branches, podiatrist, or dentist must
4     have training and experience in delivering and monitoring
5     moderate sedation and possess clinical privileges at the
6     ASTC to administer moderate sedation or analgesia.
7         (4) The supervising physician licensed to practice
8     medicine in all its branches, podiatrist, or dentist must
9     remain physically present and available on the premises
10     during the delivery of moderate sedation for diagnosis,
11     consultation, and treatment of emergency medical
12     conditions.
13         (5) The supervising physician licensed to practice
14     medicine in all its branches, podiatrist, or dentist must
15     maintain current Advanced Cardiac Life Support
16     certification or Pediatric Advanced Life Support
17     certification as appropriate to the age of the patient.
18     (c) Local, minimal, and moderate sedation shall be defined
19 by the Division of Professional Regulation of the Department of
20 Financial and Professional Regulation. Registered nurses shall
21 be limited to administering medications for moderate sedation
22 at doses rapidly reversible pharmacologically as determined by
23 rule by the Division of Professional Regulation of the
24 Department of Financial and Professional Regulation.
 
25     Section 10. The Medical Practice Act of 1987 is amended by
26 adding Section 54.6 as follows:
 
27     (225 ILCS 60/54.6 new)
28     Sec. 54.6. Registered nurse administration of limited
29 levels of anesthesia. Nothing in this Act precludes a
30 registered nurse from administering local anesthesia or
31 minimal sedation or moderate sedation, as defined by rule,
32 ordered by a physician licensed to practice medicine in all its

1 branches. The Department shall define the levels of anesthesia
2 by rule. The Department shall list the medications for moderate
3 sedation that are permitted under subsection (c) of Section 6.7
4 of the Ambulatory Surgical Treatment Act as rapidly reversible
5 pharmacologically.
 
6     Section 99. Effective date. This Act takes effect upon
7 becoming law.".
