| AN ACT concerning public health.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Department of Public Health Powers and | 5 |
| Duties Law of the
Civil Administrative Code of Illinois is | 6 |
| amended by changing Section 2310-215 as follows:
| 7 |
| (20 ILCS 2310/2310-215) (was 20 ILCS 2310/55.62)
| 8 |
| Sec. 2310-215. Center for Minority Health Services.
| 9 |
| (a) The Department shall establish a Center for Minority | 10 |
| Health
Services to advise the Department on matters pertaining | 11 |
| to the health needs
of minority populations within the State.
| 12 |
| (b) The Center shall have the following duties:
| 13 |
| (1) To assist in the assessment of the health needs of | 14 |
| minority
populations in the State.
| 15 |
| (2) To recommend treatment methods and programs that | 16 |
| are sensitive and
relevant to the unique linguistic, | 17 |
| cultural, and ethnic characteristics of
minority | 18 |
| populations.
| 19 |
| (3) To provide consultation, technical assistance, | 20 |
| training programs, and
reference materials to service | 21 |
| providers, organizations, and other
agencies.
| 22 |
| (4) To promote awareness of minority health concerns, | 23 |
| and
encourage, promote, and aid in the establishment of | 24 |
| minority services.
| 25 |
| (5) To disseminate information on available minority | 26 |
| services.
| 27 |
| (6) To provide adequate and effective opportunities | 28 |
| for minority
populations to express their views on | 29 |
| Departmental policy development and
program | 30 |
| implementation.
| 31 |
| (7) To coordinate with the Department on Aging and the | 32 |
| Department of
Public Aid to coordinate services designed to |

| meet the needs of minority senior
citizens.
| 2 |
| (8) To promote awareness of the incidence of | 3 |
| Alzheimer's disease and related dementias among minority | 4 |
| populations and to encourage, promote, and aid in the | 5 |
| establishment of prevention and treatment programs and | 6 |
| services relating to this health problem.
| 7 |
| (c) For the purpose of this Section, "minority" shall mean | 8 |
| and include
any person or group of persons who are:
| 9 |
| (1) African-American (a person having origins in any of | 10 |
| the black
racial groups in Africa);
| 11 |
| (2) Hispanic (a person of Spanish or Portuguese culture | 12 |
| with origins
in Mexico, South or Central America, or the | 13 |
| Caribbean Islands, regardless of
race);
| 14 |
| (3) Asian American (a person having origins in any of | 15 |
| the original
peoples of the Far East, Southeast Asia, the | 16 |
| Indian Subcontinent or the
Pacific Islands); or
| 17 |
| (4) American Indian or Alaskan Native (a person having | 18 |
| origins in any
of the original peoples of North America).

| Section 10. The State Finance Act is amended by adding | 21 |
| Section
5.625 as follows:

| Sec. 5.625. The Alzheimer's Disease Center Fund.

| Section 15. The Excellence in Academic Medicine Act is | 25 |
| amended by changing Section 20 and by adding Section 36 as | 26 |
| follows:

| Sec. 20. Establishment of Funds.
| 29 |
| (a) The Medical Research and Development Fund is created in | 30 |
| the State
Treasury to which the General Assembly may from time | 31 |
| to time appropriate
funds and from which the Comptroller shall | 32 |
| pay amounts as authorized by law.

| (i) The following accounts are created in the Medical | 2 |
| Research and
Development Fund: The National Institutes of | 3 |
| Health Account; the
Philanthropic Medical Research | 4 |
| Account; and the Market Medical Research
Account.
| 5 |
| (ii) Funds appropriated to the Medical Research and | 6 |
| Development Fund
shall be assigned in equal amounts to each | 7 |
| account within the Fund, subject to
transferability of | 8 |
| funds under subsection (c) of Section 25.
| 9 |
| (b) The Post-Tertiary Clinical Services Fund is created
in | 10 |
| the State Treasury to which the General Assembly may from time | 11 |
| to time
appropriate funds and from which the Comptroller shall | 12 |
| pay amounts as
authorized by law.
| 13 |
| (c) The Independent Academic Medical Center Fund is created | 14 |
| as a special
fund in the State Treasury, to which the General | 15 |
| Assembly shall from time to
time appropriate funds for the | 16 |
| purposes of the Independent Academic Medical
Center Program. | 17 |
| The amount appropriated for any fiscal year after 2002 shall
| 18 |
| not be less than the amount appropriated for fiscal year 2002. | 19 |
| The State
Comptroller shall pay amounts from the Fund as | 20 |
| authorized by law. | 21 |
| (d) The Alzheimer's Disease Center Fund is created as a | 22 |
| special fund in the State Treasury, to which the General | 23 |
| Assembly shall from time to time appropriate funds for the | 24 |
| operation of the Alzheimer's Disease Center Program. The State | 25 |
| Comptroller shall pay amounts from the Fund as authorized by | 26 |
| law.

| Sec. 36. Alzheimer's Disease Center Program. There is | 30 |
| created an Alzheimer's Disease Center Program to provide | 31 |
| financial incentives to the Regional Alzheimer's Disease | 32 |
| Assistance Centers established under the Alzheimer's Disease | 33 |
| Assistance Act. In each State fiscal year, beginning July 1, | 34 |
| 2004, each center shall receive funding under the program from | 35 |
| the funds appropriated for that purpose for that fiscal year. |

| The methodology to be used by the Illinois Department of Public | 2 |
| Aid shall be reviewed by the Advisory Committee established | 3 |
| under the Alzheimer's Disease Assistance Act and prescribed by | 4 |
| rule.
| 5 |
| Section 20. The Alzheimer's Disease Assistance Act is | 6 |
| amended by changing Sections 2, 6, and 7 as follows:

| Sec. 2. Policy declaration. The General Assembly finds that
| 9 |
| Alzheimer's disease and related disorders are devastating | 10 |
| health conditions
which destroy certain vital cells of the | 11 |
| brain and which affect an estimated

| Americans. This means that approximately 200,000

| Illinois
citizens are victims. The General Assembly also finds | 14 |
| that 50% of all
nursing home admissions in the State may be | 15 |
| attributable to the Alzheimer's
disease and related disorders | 16 |
| and that these conditions are the fourth
leading cause of death | 17 |
| among the elderly. It is the opinion of the General
Assembly | 18 |
| that Alzheimer's disease and related disorders cause serious
| 19 |
| financial, social and emotional hardships on the victims and | 20 |
| their families
of such a major consequence that it is essential | 21 |
| for the State to develop and
implement policies, plans, | 22 |
| programs and services to alleviate such hardships.
| 23 |
| The General Assembly recognizes that there is no known | 24 |
| cause or cure
of Alzheimer's disease at this time, and that it | 25 |
| can progress
over an extended period of time and to such a | 26 |
| degree that the victim's
deteriorated condition makes him or | 27 |
| her susceptible to other medical
disorders that generally prove | 28 |
| fatal. It is the intent of the General
Assembly, through | 29 |
| implementation of this Act, to establish a program for
the | 30 |
| conduct of research regarding the cause, cure and treatment of | 31 |
| Alzheimer's
disease and related disorders; and, through
the | 32 |
| establishment of Regional Alzheimer's Disease Assistance | 33 |
| Centers and
a comprehensive, Statewide system of regional and | 34 |
| community-based services,
to provide for the identification, |

| evaluation, diagnosis, referral and
treatment of victims of | 2 |
| such health problems.

| Sec. 6. ADA Advisory Committee. There is created the | 6 |
| Alzheimer's
Disease Advisory Committee consisting of 21 voting | 7 |
| members appointed by the
Director of the Department, as well as | 8 |
| 5 nonvoting members as hereinafter
provided in this Section. | 9 |
| The Director or his designee shall serve as one
of the 21 | 10 |
| voting members and as
the Chairman of the Committee. Those | 11 |
| appointed as voting members shall
include persons who are | 12 |
| experienced in
research and the delivery of services to victims | 13 |
| and their families.
Such members shall include 4 physicians | 14 |
| licensed to practice medicine in all of
its branches, one | 15 |
| representative of a postsecondary educational institution
| 16 |
| which administers or is affiliated with a medical center in the | 17 |
| State, one
representative of a licensed hospital, one | 18 |
| registered nurse, one
representative of a long term care | 19 |
| facility under the Nursing Home Care
Act, one representative of | 20 |
| an area
agency on aging as defined by Section 3.07 of the | 21 |
| Illinois Act on the
Aging, one social worker, one | 22 |
| representative of an organization established
under the | 23 |
| Illinois Insurance Code for the purpose of providing health
| 24 |
| insurance, 5 family members or representatives of victims of | 25 |
| Alzheimer's
disease and related disorders, and 4 members of the | 26 |
| general public. Among
the physician appointments shall be | 27 |
| persons with specialties in the fields
of neurology, family | 28 |
| medicine, psychiatry and pharmacology. Among the
general | 29 |
| public members, at least 2 appointments shall include persons | 30 |
| 65
years of age or older.
| 31 |
| In addition to the 21 voting members, the Secretary of | 32 |
| Human Services (or
his or her designee) and
one additional | 33 |
| representative of the Department of Human Services designated | 34 |
| by
the Secretary plus the Directors of the following
State | 35 |
| agencies or their designees shall serve as nonvoting members:

| Department on Aging, Department
of Public Aid, and Guardianship | 2 |
| and Advocacy Commission.
| 3 |
| Each voting member appointed by the
Director of Public | 4 |
| Health shall serve for a term of 2 years, and until his
| 5 |
| successor is appointed and qualified. Members of the Committee | 6 |
| shall not
be compensated but shall be reimbursed for expenses | 7 |
| actually incurred in
the performance of their duties. No more | 8 |
| than 11 voting members may be of
the same political party. | 9 |
| Vacancies shall be filled in the same manner as
original | 10 |
| appointments.
| 11 |
| The Committee shall review and evaluate State programs and | 12 |
| services provided by State agencies that are directed toward | 13 |
| persons with Alzheimer's disease and related dementias, and | 14 |
| recommend changes to improve the State's response to this | 15 |
| serious health problem. | 16 |

| Sec. 7. Regional ADA center funding. Pursuant to
| 19 |
| appropriations enacted by the General Assembly, the Department | 20 |
| shall
provide funds to hospitals affiliated with each
Regional | 21 |
| ADA Center for
necessary research and
for the development and | 22 |
| maintenance of services for victims of Alzheimer's
disease and | 23 |
| related disorders and their families. For the fiscal year
| 24 |
| beginning July 1, 2003, and each year thereafter, the | 25 |
| Department shall effect
payments under this Section to | 26 |
| hospitals affiliated with each Regional ADA
Center through the | 27 |
| Illinois Department of Public Aid under the Excellence in | 28 |
| Academic Medicine Act. The Department of Public Aid shall | 29 |
| consult with the Advisory Committee established under this Act | 30 |
| prior to implementing the payment methodology, and each year | 31 |
| thereafter to ensure that the purpose of this Act and the goals | 32 |
| and objectives of the State are being realized . The Department | 33 |
| shall
include the annual expenditures for this purpose in the | 34 |
| plan required by
Section 5 of this Act.
