1 AMENDMENT TO SENATE BILL 332
2 AMENDMENT NO. . Amend Senate Bill 332 on page 1,
3 immediately below line 25, by inserting the following:
4 "Section 10. The Illinois Certified Shorthand Reporters
5 Act of 1984 is amended by changing Section 17 as follows:
6 (225 ILCS 415/17) (from Ch. 111, par. 6217)
7 (Section scheduled to be repealed on January 1, 2004)
8 Sec. 17. Fees; returned checks; expiration while in
9 military.
10 (a) The fees for the administration and enforcement of
11 this Act, including but not limited to, original
12 certification, renewal and restoration, shall be set by rule.
13 (b) Beginning July 1, 2003, all of the fees and fines
14 collected under this Act shall be deposited into the General
15 Professions Dedicated Fund.
16 (c) Any person who delivers a check or other payment to
17 the Department that is returned to the Department unpaid by
18 the financial institution upon which it is drawn shall pay to
19 the Department, in addition to the amount already owed to the
20 Department, a fine of $50. The fines imposed by this Section
21 are in addition to any other discipline provided under this
22 Act prohibiting unlicensed practice or practice on a

1 nonrenewed license. The Department shall notify the person
2 that payment of fees and fines shall be paid to the
3 Department by certified check or money order within 30
4 calendar days of the notification. If, after the expiration
5 of 30 days from the date of the notification, the person has
6 failed to submit the necessary remittance, the Department
7 shall automatically terminate the license or certificate or
8 deny the application, without hearing. If, after termination
9 or denial, the person seeks a license or certificate, he or
10 she shall apply to the Department for restoration or issuance
11 of the license or certificate and pay all fees and fines due
12 to the Department. The Department may establish a fee for the
13 processing of an application for restoration of a license or
14 certificate to pay all expenses of processing this
15 application. The Director may waive the fines due under this
16 Section in individual cases where the Director finds that the
17 fines would be unreasonable or unnecessarily burdensome.
18 However, any person whose license has expired while he
19 has been engaged (l) in federal or state service active duty,
20 or (2) in training or education under the supervision of the
21 United States preliminary to induction into the military
22 service, may have his license renewed, reinstated or restored
23 without paying any lapsed renewal and restoration fees, if
24 within 2 years after termination of such service, training or
25 education other than by dishonorable discharge, he furnishes
26 the Department with satisfactory proof that he has been so
27 engaged and that his service, training or education has been
28 so terminated.
