1 AN ACT concerning professional regulation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Pharmacy Practice Act of 1987 is amended
5 by changing Section 16 as follows:
6 (225 ILCS 85/16) (from Ch. 111, par. 4136)
7 (Section scheduled to be repealed on January 1, 2008)
8 Sec. 16. The Department shall require and provide for
9 the licensure of every pharmacy doing business in this State.
10 Such licensure shall expire 3010 days after the pharmacist
11 in charge dies or leaves the place where the pharmacy is
12 licensed or after such pharmacist's license has been
13 suspended or revoked.
14 In the event the designated pharmacist in charge dies or
15 otherwise ceases to function in that capacity, or when the
16 license of the pharmacist in charge has been suspended or
17 revoked, the owner of the pharmacy shall be required to
18 notify the Department, on forms provided by the Department,
19 of the identity of the new pharmacist in charge.
20 It is the duty of every pharmacist in charge who ceases
21 to function in that capacity to report to the Department
22 within 3010 days of the date on which he ceased such
23 functions for such pharmacy. It is the duty of every owner
24 of a pharmacy licensed under this Act to report to the
25 Department within 3010 days of the date on which the
26 pharmacist in charge died or ceased to function in that
27 capacity. Failure to provide such notification to the
28 Department shall be grounds for disciplinary action.
29 No license shall be issued to any pharmacy unless such
30 pharmacy has a pharmacist in charge and each such pharmacy
31 license shall indicate on the face thereof the pharmacist in

3 Section 99. Effective date. This Act takes effect upon
4 becoming law.
