1 AMENDMENT TO HOUSE BILL 1027
2 AMENDMENT NO. . Amend House Bill 1027 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Park District Code is amended by adding
5 Section 5-2e as follows:
6 (70 ILCS 1205/5-2e new)
7 Sec. 5-2e. Park district property within municipality
8 with recreation board; disconnection. Whenever any property
9 within a park district created under this Code also lies
10 within the boundaries of a municipality that has established
11 a recreation board under Section 11-95-3 of the Illinois
12 Municipal Code and the property is being taxed by both the
13 park district and the municipality for recreation services,
14 10% or more of the legal voters residing within the territory
15 may propose to be disconnected and may file a petition with
16 the circuit court for the county that contains the largest
17 portion of the territory to cause the question to be
18 submitted to the legal voters of the territory proposed to be
19 disconnected. This Section applies only to park districts
20 located within 2 counties, one with a population of 3,000,000
21 or more and the other with a population between 500,000 and
22 550,000, and a municipality with a population between 55,000

1 and 60,000.
2 The court shall order the question of disconnection
3 submitted to the electors residing in the territory. The
4 Clerk of the Circuit Court shall certify the question to the
5 proper election authorities at an election in accordance with
6 the general election law for submission.
7 The question cast at this election shall be in
8 substantially the following form:
9 Shall the (describe territory) be disconnected from
10 (name of park district)?
11 The votes shall be recorded as "Yes" or "No".
12 If a majority of the electors voting upon the
13 disconnection question vote for disconnection; the
14 disconnection shall be effective.
15 This Section is repealed on January 1, 2005.
16 Section 99. Effective date. This Act takes effect upon
17 becoming law.".
