1 AMENDMENT TO HOUSE BILL 60
2 AMENDMENT NO. . Amend House Bill 60 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The University of Illinois Act is amended by
5 adding Section 7e-5 as follows:
6 (110 ILCS 305/7e-5 new)
7 Sec. 7e-5. In-state tuition charge.
8 (a) Notwithstanding any other provision of law to the
9 contrary, for tuition purposes, the Board of Trustees shall
10 deem an individual an Illinois resident, until the individual
11 establishes a residence outside of this State, if all of the
12 following conditions are met:
13 (1) The individual resided with his or her parent
14 or guardian while attending a public or private high
15 school in this State.
16 (2) The individual graduated from a public or
17 private high school or received the equivalent of a high
18 school diploma in this State.
19 (3) The individual attended school in this State
20 for at least 3 years as of the date the individual
21 graduated from high school or received the equivalent of
22 a high school diploma.

1 (4) The individual registers as an entering student
2 in the University not earlier than the 2003 fall
3 semester.
4 (5) In the case of an individual who is not a
5 citizen or a permanent resident of the United States, the
6 individual provides the University with an affidavit
7 stating that the individual will file an application to
8 become a permanent resident of the United States at the
9 earliest opportunity the individual is eligible to do so.
10 (b) This Section applies only to tuition for a term or
11 semester that begins on or after the effective date of this
12 amendatory Act of the 93rd General Assembly. Any revenue lost
13 by the University in implementing this Section shall be
14 absorbed by the University Income Fund.
15 Section 10. The Southern Illinois University Management
16 Act is amended by adding Section 8d-5 as follows:
17 (110 ILCS 520/8d-5 new)
18 Sec. 8d-5. In-state tuition charge.
19 (a) Notwithstanding any other provision of law to the
20 contrary, for tuition purposes, the Board shall deem an
21 individual an Illinois resident, until the individual
22 establishes a residence outside of this State, if all of the
23 following conditions are met:
24 (1) The individual resided with his or her parent
25 or guardian while attending a public or private high
26 school in this State.
27 (2) The individual graduated from a public or
28 private high school or received the equivalent of a high
29 school diploma in this State.
30 (3) The individual attended school in this State
31 for at least 3 years as of the date the individual
32 graduated from high school or received the equivalent of

1 a high school diploma.
2 (4) The individual registers as an entering student

22 individual an Illinois resident, until the individual
23 establishes a residence outside of this State, if all of the
24 following conditions are met:

28 (2) The individual graduated from a public or
29 private high school or received the equivalent of a high
30 school diploma in this State.

23 individual an Illinois resident, until the individual

30 school in this State.
31 (2) The individual graduated from a public or
32 private high school or received the equivalent of a high

25 contrary, for tuition purposes, the Board shall deem an
26 individual an Illinois resident, until the individual
27 establishes a residence outside of this State, if all of the
28 following conditions are met:
29 (1) The individual resided with his or her parent
30 or guardian while attending a public or private high
31 school in this State.
32 (2) The individual graduated from a public or

28 establishes a residence outside of this State, if all of the
29 following conditions are met:
30 (1) The individual resided with his or her parent
31 or guardian while attending a public or private high
32 school in this State.

26 (a) Notwithstanding any other provision of law to the
27 contrary, for tuition purposes, the Board shall deem an
28 individual an Illinois resident, until the individual
29 establishes a residence outside of this State, if all of the
30 following conditions are met:
31 (1) The individual resided with his or her parent
32 or guardian while attending a public or private high

1 school in this State.
2 (2) The individual graduated from a public or
3 private high school or received the equivalent of a high
4 school diploma in this State.
5 (3) The individual attended school in this State

9 (4) The individual registers as an entering student

24 by adding Section 6-4a as follows:
25 (110 ILCS 805/6-4a new)
26 Sec. 6-4a. In-state tuition charge.
27 (a) Notwithstanding any other provision of law to the
28 contrary, for tuition purposes, a board shall deem an
29 individual an Illinois resident, until the individual
30 establishes a residence outside of this State, if all of the
31 following conditions are met:
32 (1) The individual resided with his or her parent or

1 guardian while attending a public or private high school
2 in this State.
3 (2) The individual graduated from a public or
4 private high school or received the equivalent of a high
5 school diploma in this State.
6 (3) The individual attended school in this State for
7 at least 3 years as of the date the individual graduated
8 from high school or received the equivalent of a high
9 school diploma.
10 (4) The individual registers as an entering student
11 in the community college not earlier than the 2003 fall
12 semester.
13 (5) In the case of an individual who is not a
14 citizen or a permanent resident of the United States, the
15 individual provides the community college with an
16 affidavit stating that the individual will file an
17 application to become a permanent resident of the United
18 States at the earliest opportunity the individual is
19 eligible to do so.
20 (b) This Section applies only to tuition for a term or
21 semester that begins on or after the effective date of this
22 amendatory Act of the 93rd General Assembly.
23 Section 99. Effective date. This Act takes effect upon
24 becoming law.".
