SYNOPSIS AS INTRODUCED:

225 ILCS 41/15-33 new

Amends the Funeral Directors and Embalmers Licensing Code. Provides that no license is required for an organ procurement organization or its authorized representative to transport a deceased human body from its place of death, institution, or other location if the organ procurement organization satisfies specified requirements.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Funeral Directors and Embalmers Licensing Code is amended by adding Section 15-33 as follows:

(225 ILCS 41/15-33 new)

Sec. 15-33. Exceptions to unlicensed practice. No license is required under this Code for an organ procurement organization or its authorized representative to transport a deceased human body from its place of death, institution, or other location if the organ procurement organization is:

(1) certified by the Centers for Medicare and Medicaid Services;

(2) transporting the deceased human body for the purposes of organ or tissue donation; and

(3) transporting the deceased human body within the viable timeframe for organ or tissue donation.
