SENATE RESOLUTION

 
2    WHEREAS, The Illinois State Police and local law
3enforcement agencies operating in the State of Illinois should
4be using their gang databases appropriately to identify and
5target known gang activities; and
 
6    WHEREAS, Labeling a person as a gang member can result in
7adverse effects on someone's life and has led to assumptions
8being made about our young people who have done nothing wrong;
9and
 
10    WHEREAS, These lists should not be used to target or
11intimidate the citizens in our communities, and should solely
12be used as a tool to keep our law enforcement agents safe; and
 
13    WHEREAS, Individuals from our communities should not be
14added to the shared gang and gang databases erroneously and
15should only be added if they pose a threat to public safety;
16and
 
17    WHEREAS, Giving our law enforcement agencies the most
18up-to-date tools necessary for targeting people who aim to do
19harm in our communities is of the utmost importance; and
 
20    WHEREAS, Gang databases have been established to provide

1identifying information about violent criminal gangs and
2members of those gangs to law enforcement personnel; and
 
3    WHEREAS, Gang member information serves to warn law
4enforcement officers of the potential danger posed by violent
5individuals, and promote the exchange of information about gang
6groups and gang members to facilitate criminal investigations;
7and
 
8    WHEREAS, Since gang member information is based, in part,
9on investigative information not previously subject to
10independent judicial review, strict adherence to policy on the
11access, use, dissemination, and security of gang information is
12necessary to ensure that individuals' constitutional rights,
13civil liberties, civil rights, and privacy interests are
14protected; and
 
15    WHEREAS, Law enforcement agencies should have standards of
16practice surrounding the issue of adding people to gang
17databases; and
 
18    WHEREAS, Law enforcement agencies should review the people
19who have been added to their gang database list and try to find
20a reasonable way to remove people that should not be on them;
21therefore, be it

1    RESOLVED, BY THE SENATE OF THE ONE HUNDREDTH GENERAL
2ASSEMBLY OF THE STATE OF ILLINOIS, that the Illinois Criminal
3Justice Information Authority (ICJIA) is directed to conduct a
4review of the shared gang databases operating in Illinois; and
5be it further
 
6    RESOLVED, That this review should identify which law
7enforcement agencies use the shared gang and gang databases and
8the policies surrounding their use; and be it further
 
9    RESOLVED, That the ICJIA shall commence this review as soon
10as is practical and report its findings by January 9, 2019; and
11be it further
 
12    RESOLVED, That the report filed with the General Assembly
13shall be filed with the Secretary of the Senate and the Clerk
14of the House of Representatives in electronic form only, in the
15manner that the Secretary and Clerk shall direct; and be it
16further
 
17    RESOLVED, That a suitable copy of this resolution be
18delivered to the ICJIA.
