SYNOPSIS AS INTRODUCED:
 
ILCON Art. VIII, Sec. 5 new

    Proposes to amend the Finance Article of the Illinois Constitution. Provides that in no fiscal year shall the rate of growth of General Revenue Fund appropriations over the preceding fiscal year exceed the rate of growth of the Illinois economy. Provides that if the General Assembly by adoption of a resolution approved by a record vote of a majority of the members of each house finds that an emergency exists and identifies the nature of the emergency, the General Assembly may provide for appropriations in excess of the amount authorized. Provides that the authorized excess amount may not exceed the amount specified in the resolution. Effective upon being declared adopted.

3    RESOLVED, BY THE SENATE OF THE ONE HUNDREDTH GENERAL
4ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES
5CONCURRING HEREIN, that there shall be submitted to the
6electors of the State for adoption or rejection at the general
7election next occurring at least 6 months after the adoption of
8this resolution a proposition to add Section 5 to Article VIII
9of the Illinois Constitution as follows:

13SECTION 5. RATE OF GROWTH OF APPROPRIATIONS
14    (a) In no fiscal year shall the rate of growth of General
15Revenue Fund appropriations over the preceding fiscal year
16exceed the rate of growth of the Illinois economy. For the
17purposes of this Section, the rate of growth of the Illinois
18economy is the average annual growth rate of per capita gross
19domestic product in the State over the preceding ten calendar
20years, using data reported by the federal Bureau of Economic
21Analysis, or its successor agency, before December 31
22immediately preceding the beginning of the fiscal year. The
23General Assembly shall provide by law for the implementation of

1this subsection (a).
2    (b) If the General Assembly by adoption of a resolution
3approved by a record vote of a majority of the members of each
4house finds that an emergency exists and identifies the nature
5of the emergency, the General Assembly may provide for
6appropriations in excess of the amount authorized by subsection
7(a) of this Section. The excess authorized under this
8subsection (b) may not exceed the amount specified in the
9resolution.

SCHEDULE
11    This Constitutional Amendment takes effect upon being
12declared adopted in accordance with Section 7 of the Illinois
13Constitutional Amendment Act.
