SYNOPSIS AS INTRODUCED:
 
225 ILCS 60/23.1 new

    Amends the Medical Practice Act of 1987. Provides that every physician shall report to the Secretary of State certain medical conditions of a driver that are likely to cause loss of consciousness or any loss of ability to safely operate a motor vehicle within 10 days of the physician becoming aware of the condition. Provides that the Secretary of State, in conjunction with the Driver's License Medical Advisory Board, shall determine by administrative rule the temporary conditions not required to be reported. Provides that all information furnished to the Secretary shall be deemed confidential and for the privileged use of the Secretary. Provides that physicians who make the report required by this Section shall be immune from civil or criminal liability for a motor vehicle accident caused by the medical condition.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. This Act may be referred to as Vanessa's Law.
 
5    Section 5. The Medical Practice Act of 1987 is amended by
6adding Section 23.1 as follows:
 
7    (225 ILCS 60/23.1 new)
8    Sec. 23.1. Duty to report medical condition. Every
9physician shall report to the Secretary of State any medical
10condition, as defined by the Driver's License Medical Review
11Law of 1992 (Article IX of Chapter 6 of the Illinois Vehicle
12Code), of a driver that is likely to cause loss of
13consciousness or any loss of ability to safely operate a motor
14vehicle within 10 days of the physician becoming aware of the
15condition. The Secretary of State, in conjunction with the
16Driver's License Medical Advisory Board, shall determine by
17administrative rule the temporary conditions not required to be
18reported under the provisions of this Section. All information
19furnished to the Secretary under the provisions of this Section
20shall be deemed confidential and for the privileged use of the
21Secretary in accordance with the provisions of subsection (j)
22of Section 2-123 of the Illinois Vehicle Code. Physicians who
