SYNOPSIS AS INTRODUCED:

    Amends the Illinois Highway Code. Provides that the Department of Transportation shall allow the use of asphalt rejuvenating agents and binder performance grade modifiers in mix designs used for the construction and maintenance of State highways. Provides that all asphalt roofing shingles used in Department projects shall be from recycling facilities that are approved by the Illinois Environmental Protection Agency and that are in compliance with the operational guidelines and asbestos-testing requirements.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Highway Code is amended by changing
5Sections 4-221 and 4-222 as follows:
 
6    (605 ILCS 5/4-221)
7    Sec. 4-221. Mix designs. To the extent allowed by federal
8law, the Department specifications shall allow the use of
9recycled asphalt roofing shingles, including asphalt
10rejuvenating agents and binder performance grade modifiers, in
11mix designs used for the construction and maintenance of State
12highways. All asphalt roofing shingles used in Department
13projects shall be from recycling facilities that are approved
14by the Illinois Environmental Protection Agency and that are in
15compliance with the operational guidelines and
16asbestos-testing requirements set forth by the Agency under
17received from facilities authorized to process asphalt roofing
18shingles for recycling into asphalt pavement in accordance with
19(i) permits issued pursuant to Section 39 of the Environmental
20Protection Act or (ii) beneficial use determinations issued
21pursuant to Section 22.54 of the Environmental Protection Act.
22In creating the mix designs used for construction and
23maintenance of State highways, it shall be the goal of the

1Department, through its specifications, to maximize the
2percentage of recycled asphalt roofing shingles and binder
3replacement and to maximize the use of recycled aggregates and
4other lowest-cost constituents in the mix, including asphalt
5rejuvenating agents and binder performance grade modifiers, so
6long as there is no detrimental impact on life-cycle costs.

9    Sec. 4-222. Recycled asphalt roofing shingles; cost
10savings; prohibitions on use in asphalt paving.
11    (a) It shall be the goal of the Department, with regard to
12its asphalt paving projects and to the extent possible, to
13reduce the carbon footprint and reduce average costs by
14maximizing the percentage use of recycled materials or lowest
15cost alternative materials, including asphalt rejuvenating
16agents and binder performance grade modifiers, and extending
17the paving season so long as there is no detrimental impact on
18life-cycle costs. In furtherance of these goals, the Department
19shall provide to the Chairpersons of the Transportation
20Committee in each legislative chamber, within 60 days after the
21completion of each fiscal year, a written report of the
22activities initiated or abandoned in each district or region
23within the Department to meet those goals during the previous
24year. The report shall also include an analysis of the cost
25savings directly or indirectly attributed to those activities

1within each district or region. Upon review of the annual
2report, the Transportation Committees in each chamber may
3conduct hearings and provide recommendations to the Department
4regarding the performance of each district or region.
5    (b) No producer of asphalt pavement, operating pursuant to
6an air permit issued by the Illinois Environmental Protection
7Agency, shall use recycled asphalt roofing shingles in its
8pavement product unless the shingles have been processed for
9recycling into asphalt pavement in accordance with (i) permits
10issued pursuant to Section 39 of the Environmental Protection
11Act or (ii) beneficial use determinations issued pursuant to
12Section 22.54 of the Environmental Protection Act. The
13prohibition in this subsection (b) shall apply in addition to
14any other rules, specifications, or other requirements adopted
15by the Department regarding the use of asphalt roofing shingles
16in pavement product.
