1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by changing Section 2310-617 as follows:
 
7    (20 ILCS 2310/2310-617)
8    Sec. 2310-617. Human papillomavirus vaccine.
9    (a) As used in this Section, "eligible individual" means a
10female child under the age of 18, and, beginning on January 1,
112020, a male child under the age of 18, who is a resident of
12Illinois who: (1) is not entitled to receive a human
13papillomavirus (HPV) vaccination at no cost as a benefit under
14a plan of health insurance, a managed care plan, or a plan
15provided by a health maintenance organization, a health
16services plan corporation, or a similar entity, and (2) meets
17the requirements established by the Department of Public Health
18by rule.
19    (b) Subject to appropriation, the Department of Public
20Health shall establish and administer a program, commencing no
21later than July 1, 2011, under which any eligible individual
22shall, upon the eligible individual's request, receive a series
23of HPV vaccinations as medically indicated, at no cost to the

1eligible individual.
2    (c) The Department of Public Health shall adopt rules for
3the administration and operation of the program, including, but
4not limited to: determination of the HPV vaccine formulation to
5be administered and the method of administration; eligibility
6requirements and eligibility determinations; and standards and
7criteria for acquisition and distribution of the HPV vaccine
8and related supplies. The Department may enter into contracts
9or agreements with public or private entities for the
10performance of such duties under the program as the Department
11may deem appropriate to carry out this Section and its rules
12adopted under this Section.

14    Section 10. The Communicable Disease Prevention Act is
15amended by changing Section 2e as follows:
 
16    (410 ILCS 315/2e)
17    Sec. 2e. HPV-related Cervical cancer prevention.
18    (a) Notwithstanding the provisions of Section 2 of this
19Act, beginning August 1, 2007, the Department of Public Health
20must provide all female students who are entering sixth grade
21and their parents or legal guardians written information about
22the link between human papillomavirus (HPV) and cervical,
23vulvar, vaginal, penile, anal, and oropharyngeal cancers in
24males and females, as applicable, and the availability of a HPV

1vaccine so that they may be protected before ever being exposed
2to the virus cervical cancer and the availability of a HPV
3vaccine.
4    (b) The Director of Public Health shall prescribe the
5content of the information required in subsection (a) of this
6Section.
7    (c) In order to provide for the expeditious and timely
8implementation of the provisions of this amendatory Act of the
995th General Assembly, the Department of Public Health shall
10adopt emergency rules in accordance with Section 5-45 of the
11Illinois Administrative Procedure Act to the extent necessary
12to administer the Department's responsibilities under this
13amendatory Act of the 95th General Assembly. The adoption of
14emergency rules authorized by this subsection (c) is deemed to
15be necessary for the public interest, safety, and welfare.
16    (d) In order to provide for the expeditious and timely
17implementation of the provisions of this amendatory Act of the
18100th General Assembly, the Department of Public Health shall
19adopt emergency rules in accordance with Section 5-45 of the
20Illinois Administrative Procedure Act to the extent necessary
21to administer the Department's responsibilities under this
22amendatory Act of the 100th General Assembly no later than July
231, 2019. The adoption of emergency rules authorized by this
24subsection (d) is deemed to be necessary for the public
25interest, safety, and welfare.
