HOUSE RESOLUTION

 
2    WHEREAS, Illinois is the home of the world's first juvenile
3court, beginning in 1899 in Cook County; and
 
4    WHEREAS, Illinois has long recognized the need to ensure
5all our State's children have an equal and fair right to
6justice when in conflict with the law; and
 
7    WHEREAS, Issued 50 years ago on May 15, 1967, In re Gault,
8387 U.S. 1 (1967), was a landmark U.S. Supreme Court decision
9that ensured the right to a lawyer for children accused of
10crimes in juvenile court; the ruling also provided other due
11process rights, including the right to be notified of the
12charges, the right to cross-examine witnesses, and the right to
13not make a statement against oneself; and
 
14    WHEREAS, Illinois complies with In re Gault through the
15statutory requirement of due process protections for all
16children in conflict with the law, including the requirement of
17a lawyer appointed at the first court hearing; and
 
18    WHEREAS, Illinois has been at the forefront of national
19reforms to ensure that all our children receive fundamentally
20fair and humane treatment throughout the juvenile justice
21system; therefore, be it

1    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE
2HUNDREDTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we
3recognize the landmark 1967 United States Supreme Court
4decision of In re Gault, by ensuring that Illinois fully honors
5the promise of Gault and of the juvenile court by ensuring that
6detention or confinement to State juvenile prison is a last
7resort and for as short a time as possible, by ensuring all
8children begin their case in juvenile court, by ensuring all
9children receive the protection of counsel beginning at the
10first point of contact, and by ensuring that all our children
11receive fundamentally fair and humane treatment within the
12juvenile justice system.
