1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-1002 as follows:
 
6    (625 ILCS 5/11-1002)  (from Ch. 95 1/2, par. 11-1002)
7    Sec. 11-1002. Pedestrians' right-of-way at crosswalks.
8    (a) When traffic control signals are not in place or not in
9operation the driver of a vehicle shall stop and yield the
10right-of-way to a pedestrian crossing the roadway within a
11crosswalk when the pedestrian is upon the half of the roadway
12upon which the vehicle is traveling, or when the pedestrian is
13approaching so closely from the opposite half of the roadway as
14to be in danger.
15    (b) No pedestrian shall suddenly leave a curb or other
16place of safety and walk or run into the path of a moving
17vehicle which is so close as to constitute an immediate hazard.
18    (c) Paragraph (a) shall not apply under the condition
19stated in Section 11-1003(b).
20    (d) Whenever any vehicle is stopped at a marked crosswalk
21or at any unmarked crosswalk at an intersection to permit a
22pedestrian to cross the roadway, the driver of any other
23vehicle approaching from the rear shall not overtake and pass

1such stopped vehicle.
2    (e) Whenever stop signs or flashing red signals are in
3place at an intersection or at a plainly marked crosswalk
4between intersections, drivers shall yield right-of-way to
5pedestrians as set forth in Section 11-904 of this Chapter.
6    (f) Whenever a pedestrian crossing warning sign with a
7rectangular rapid flashing beacon is in place at an
8intersection where traffic control signals are not in place or
9at a plainly marked crosswalk, a driver of a vehicle shall stop
10and yield the right-of-way to a pedestrian when the rectangular
11rapid flashing beacon is activated. For purposes of this
12subsection (f), "rectangular rapid flashing beacon" means a
13pedestrian-activated LED beacon system with 2 rapidly and
14alternately flashing rectangular yellow lights that conforms
15to Federal Highway Administration guidelines.
16    A violation of this subsection is a Class C misdemeanor,
17except that a violation that results in serious bodily injury
18or death to another is a Class 4 felony.
