SYNOPSIS AS INTRODUCED:
 
430 ILCS 66/80

    Amends the Firearm Concealed Carry Act. Provides that the Department of State Police shall allow by rule a waiver process for a person seeking to become a certified firearms instructor who meets all the other requirements of the Act except the high school education requirements.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Firearm Concealed Carry Act is amended by
5changing Section 80 as follows:
 
6    (430 ILCS 66/80)
7    Sec. 80. Certified firearms instructors.
8    (a) Within 60 days of the effective date of this Act, the
9Department shall begin approval of certified firearms
10instructors and enter certified firearms instructors into an
11online registry on the Department's website.
12    (b) A person who is not a certified firearms instructor
13shall not teach applicant training courses or advertise or
14otherwise represent courses they teach as qualifying their
15students to meet the requirements to receive a license under
16this Act. Each violation of this subsection is a business
17offense with a fine of at least $1,000 per violation.
18    (c) A person seeking to become a certified firearms
19instructor shall:
20        (1) be at least 21 years of age;
21        (2) be a legal resident of the United States; and
22        (3) meet the requirements of Section 25 of this Act,
23    except for the Illinois residency requirement in item (xiv)

1    of paragraph (2) of subsection (a) of Section 4 of the
2    Firearm Owners Identification Card Act; and any additional
3    uniformly applied requirements established by the
4    Department.
5    (d) A person seeking to become a certified firearms
6instructor, in addition to the requirements of subsection (c)
7of this Section, shall:
8        (1) possess a high school diploma or high school
9    equivalency certificate; and
10        (2) have at least one of the following valid firearms
11    instructor certifications:
12            (A) certification from a law enforcement agency;
13            (B) certification from a firearm instructor course
14        offered by a State or federal governmental agency;
15            (C) certification from a firearm instructor
16        qualification course offered by the Illinois Law
17        Enforcement Training Standards Board; or
18            (D) certification from an entity approved by the
19        Department that offers firearm instructor education
20        and training in the use and safety of firearms.
21    (d-5) The Department shall allow by rule a waiver process
22for a person seeking to become a certified firearms instructor
23if the person meets all the other requirements of subsections
24(c) and (d) of this Section except paragraph (1) of subsection
25(d) of this Section.
26    (e) A person may have his or her firearms instructor

1certification denied or revoked if he or she does not meet the
2requirements to obtain a license under this Act, provides false
3or misleading information to the Department, or has had a prior
4instructor certification revoked or denied by the Department.
