SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/14-7.01a new

    Amends the Children with Disabilities Article of the School Code. Provides that the parent or guardian of a child with disabilities who resides in a school district shall have the option of enrolling the child in a school district in which the child was previously enrolled as long as that school district is, in whole or in part, within the county in which the child currently resides. Requires the school district in which the child currently resides to grant proper permit to the child's parent or guardian to allow the child to enroll in a school district outside of the district in which he or she resides. Sets forth provisions concerning special education reimbursement, evidence-based funding apportionment, and transportation costs. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
514-7.01a as follows:
 
6    (105 ILCS 5/14-7.01a new)
7    Sec. 14-7.01a. Children enrolling in previous district.
8    (a) In this Section, "enrolling school district" means a
9school district in which a parent or guardian chooses to enroll
10a child with disabilities outside of the school district in
11which the child currently resides, but within, in whole or in
12part, the county in which the child currently resides.
13    (b) The parent or guardian of a child with disabilities who
14resides in a school district shall have the option of enrolling
15the child in a school district in which the child was
16previously enrolled as long as that school district is, in
17whole or in part, within the county in which the child
18currently resides. The school district in which the child
19currently resides shall grant proper permit to the child's
20parent or guardian to allow the child to enroll in a school
21district outside of the district in which he or she resides.
22    (c) For purposes of reimbursement under this Article and
23for evidence-based funding apportionment purposes under

1Section 18-8.15 of this Code, a child with disabilities
2enrolled as permitted under subsection (b) of this Section
3shall be a pupil enrolled in the enrolling school district.
4    (d) The parent or guardian of a child with disabilities
5enrolled as permitted under subsection (b) of this Section
6shall incur all costs associated with transportation, and
7neither school district is eligible for transportation
8reimbursement under Section 14-13.01 or Section 29-5 of this
9Code.
 
10    Section 99. Effective date. This Act takes effect upon
11becoming law.
