SYNOPSIS AS INTRODUCED:
 
65 ILCS 5/11-124.3 new

    Amends the Illinois Municipal Code. Provides that a municipality that supplies water to 2 or more municipalities must submit a report no later than 60 days after the effective date of the amendatory Act and then annually on or before January 1 to each municipality to which it supplies water. Provides that the report must contain the water rates for each municipality that is supplied water and, if the water rates differ between the municipalities that receive water, a justification as to why water rates are different between municipalities. Provides that if the municipality changes water rates causing water rates to be different between the municipalities, the municipality must submit a report to each municipality to which it supplies water no later than 5 business days after the change in water rates unless the change is reflected in the annual report. Limits home rule powers.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by adding
5Section 11-124.3 as follows:
 
6    (65 ILCS 5/11-124.3 new)
7    Sec. 11-124.3. Annual report.
8    (a) A municipality that supplies water to 2 or more
9municipalities must submit a report no later than 60 days after
10the effective date of this amendatory Act of the 100th General
11Assembly and then annually on or before January 1 to each
12municipality to which it supplies water. The report must
13contain the water rates for each municipality that is supplied
14water. If the water rates differ between the municipalities
15that receive water, the report must contain a justification as
16to why water rates are different between municipalities.
17    (b) If a municipality that supplies water to 2 or more
18municipalities changes water rates causing water rates to be
19different between the municipalities that it supplies water,
20the municipality must submit a report that meets the
21requirements of subsection (a) to each municipality to which it
22supplies water no later than 5 business days after the change
23in water rates unless the change is reflected in the annual

2    (c) A home rule municipality must provide reports as
3required by this Section and may not prepare the reports in a
4manner inconsistent with this Section. This Section is a
5limitation under subsection (i) of Section 6 of Article VII of
6the Illinois Constitution on the concurrent exercise by home
7rule units of powers and functions exercised by the State.
