SYNOPSIS AS INTRODUCED:
 
15 ILCS 20/50-23 new

    Amends the State Budget Law of the Illinois Civil Administrative Code. Creates the State Board of Elections Independent Funding Law. Creates a continuing appropriation for the State Board of Elections which provides that total appropriations from all sources shall be no less than total appropriations from all sources for the previous fiscal year. Creates an irrevocable and continuing appropriation for the State Board of Elections for the distribution of any federal funds received by the State Board of Elections for the purposes authorized by the federal government for those funds. Authorizes the State Treasurer and State Comptroller to make distributions of federal funds as provided. Defines "total appropriations from all sources". Effective immediately.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Budget Law of the Civil Administrative
5Code of Illinois is amended by adding Section 50-23 as follows:
 
6    (15 ILCS 20/50-23 new)
7    Sec. 50-23. State Board of Elections Independent Funding
8Law.
9    (a) The Governor shall submit to the General Assembly a
10proposed budget for the State Board of Elections in which the
11total appropriations from all sources are no less than the
12total appropriations from all sources of the previous fiscal
13year.
14    (b) If for any reason the total appropriations from all
15sources are insufficient to meet the levels required by
16subsection (a) of this Section, this Section shall constitute a
17continuing appropriation of all amounts necessary for these
18purposes. The General Assembly may appropriate lesser amounts
19by law.
20    (c) This Section shall constitute an irrevocable and
21continuing appropriation for the distribution of any federal
22funds received by the State Board of Elections for the purposes
23authorized by the federal government for those funds,

1including, but not limited to, moneys received by the Help
2America Vote Fund. Funds appropriated under this Section shall
3be disbursed in accordance with any requirements imposed by the
4federal government, and nothing in this Section shall be
5construed in such a way so as to avoid any requirements imposed
6by the federal government in disbursing funds to the State
7Board of Elections. The State Treasurer and State Comptroller
8are hereby authorized to make distributions of federal funds as
9provided in this Section.
10    (d) For purposes of this Section: "total appropriations
11from all sources" includes, but is not limited to, moneys
12appropriated from the General Revenue Fund, the Help America
13Vote Fund, the ERIC Operations Trust Fund, or any other fund of
14the State, regardless of whether the moneys appropriated from
15those funds are from a federal, State, public, or private
16source; "total appropriations from all sources" also includes
17those moneys received in the Personal Property Tax Replacement
18Fund that are to be distributed to local election authorities.
19    (e) This Section may be cited as the State Board of
20Elections Independent Funding Law.
 
21    Section 99. Effective date. This Act takes effect upon
22becoming law.
