SYNOPSIS AS INTRODUCED:

720 ILCS 5/26-8 new

Amends the Criminal Code of 2012. Creates the offense of kindling a fire on a public way. Provides that a person commits the offense when he or she knowingly lights, kindles, or burns a fire on the surface of a road, street, or other public way. Provides exemptions. Provides that a violation is a petty offense for which a fine not exceeding $1,000 may be imposed.

A BILL FOR

AN ACT concerning criminal law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Criminal Code of 2012 is amended by adding Section 26-8 as follows:

(720 ILCS 5/26-8 new)

Sec. 26-8. Kindling a fire on a public way.

(a) A person commits kindling a fire on a public way when he or she knowingly lights, kindles, or burns a fire on the surface of a road, street, or other public way.

(b) This Section does not apply to:

(1) persons engaged in construction work in a construction or maintenance speed zone as defined in Section 11-605.1 of the Illinois Vehicle Code;

(2) the use of a flare by emergency personnel; or

(3) the use of a flare to signal approaching traffic of an emergency or disabled vehicle.

(c) Sentence. Kindling a fire on a public way is a petty offense for which a fine not exceeding $1,000 may be imposed.
