SYNOPSIS AS INTRODUCED:
 
New Act
20 ILCS 2605/2605-605 new

    Creates the Law Enforcement Officer Body-worn Camera System Act. Provides that each law enforcement agency shall, no later than January 1, 2018, implement and operate a body-worn camera system with the model policy or guideline for that system established by the Department of State Police before July 1, 2017. Provides that nothing in the Act prohibits a police force that is not required to implement and operate a body-worn camera system under the Act from implementing and operating that system, provided that the system is implemented and operated in accordance with the model policy or guideline for the system established by the Department of State Police. Amends the Department of State Police Law of the Civil Administrative Code of Illinois to make conforming changes.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Law
5Enforcement Officer Body-worn Camera System Act.
 
6    Section 5. Definitions. In this Act:
7    "Body-worn camera system" means an electronic system for
8creating, generating, sending, receiving, storing, displaying,
9and processing audiovisual recordings, including cameras or
10other devices capable of creating those recordings, that may be
11worn about the person of a law enforcement officer.
12    "Law enforcement agency" means the Department of State
13Police, county sheriff's office, or municipal police
14department.
15    "Law enforcement officer" means a peace officer employed by
16the Department of State Police, county sheriff, or municipal
17police department who is assigned duties by the employing law
18enforcement agency to maintain public order or to make arrests
19for offenses or ordinance violations, but does not include a
20detective, laboratory employee, public relations officer,
21liaison, or agency attorney even if he or she meets the
22definition of peace officer but in which his or her duties do
23not primarily involve maintaining public order or making

1arrests.
2    "Peace officer" has the meaning ascribed to it in Section
32-13 of the Criminal Code of 2012.
 
4    Section 10. Law enforcement officers; body-worn camera
5system.
6    (a) Each law enforcement agency shall, no later than
7January 1, 2018, implement and operate a body-worn camera
8system with the model policy or guideline for that system
9established by the Department of State Police.
10    (b) Nothing in this Act prohibits a police force that is
11not required to implement and operate a body-worn camera system
12under this Act from implementing and operating the system;
13provided that the system is implemented and operated in
14accordance with the model policy or guideline for the system
15established by the Department of State Police.
 
16    Section 105. The Department of State Police Law of the
17Civil Administrative Code of Illinois is amended by adding
18Section 2605-605 as follows:

22    (a) In this Section, "body-worn camera system" and "law
23enforcement officer" have the meanings ascribed to them in

3    (b) Before July 1, 2017, the Department of State Police, by
4rule, shall establish a model policy or guideline for the
5implementation and use of a body-worn camera system by law
6enforcement officers.
