Amends the Illinois Municipal Code. Provides that orders for possession for housing authorities with no police force or for privately owned housing may be executed by peace officers and private detectives.

A BILL FOR

AN ACT concerning local government.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Municipal Code is amended by changing Section 1-2-11 as follows:

Sec. 1-2-11. (a) A sheriff may serve any process or make any arrest in a municipality or a part of a municipality located in the county in which the sheriff was elected that any officer of that municipality is authorized to make under this Code or any ordinance passed under this Code.

(b) Police officers may serve summons for violations of ordinances occurring within their municipalities. In municipalities with a population of 1,000,000 or more, active duty or retired police officers may serve summons for violations of ordinances occurring within their municipalities.

(c) In addition to the powers stated in Section 8.1a of the Housing Authorities Act, in counties with a population of 3,000,000 or more inhabitants, members of a housing authority police force may serve process for forcible entry and detainer actions commenced by that housing authority and may execute orders of possession for that housing authority. Orders for possession for housing authorities with no police force or for privately owned housing may be executed by "peace officers" as defined in Section 2-13 of the Criminal Code of 2012 and "private detectives" as defined in Section 5-10 of the Private Detective, Private Alarm, Private Security Fingerprint Venter, and Locksmith Act of 2004 subject to the limitations to the powers authorized under that Act.
