SYNOPSIS AS INTRODUCED:
 
50 ILCS 750/8.5 new

    Amends the Emergency Telephone System Act. Provides that a public safety agency, public agency, qualified governmental entity, or Emergency Telephone System Board may seek reimbursement from the Illinois Commerce Commission (ICC) for installation of an additional trunk line due to an employee or designee of a public safety agency being required to physically transfer 9-1-1 calls at the private branch exchange due to a failure by a system provider's trunk line 3 or more times within a 12-month period. Provides that repair and monthly trunk line fees will also be reimbursed by the ICC. Provides that the ICC shall not provide reimbursement for more than one additional trunk line and related repairs and fees. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Emergency Telephone System Act is amended by
5adding Section 8.5 as follows:
 
6    (50 ILCS 750/8.5 new)
7    Sec. 8.5. Reimbursement for additional trunk line
8installation, repairs, and fees.
9    (a) A public safety agency, public agency, qualified
10governmental entity, or Emergency Telephone System Board may
11seek reimbursement from the Commission for installation of an
12additional trunk line to a public safety agency's 9-1-1 system
13by submitting one or more affidavits to the Commission stating
14that:
15        (1) an employee or designee of a public safety agency
16    was required to physically transfer 9-1-1 calls at the
17    private branch exchange due to a failure by a system
18    provider's trunk line 3 or more times within a 12-month
19    period;
20        (2) an additional trunk line has been installed
21    following the occurrences in paragraph (1); and
22        (3) a receipt evidencing the installation of the
23    additional trunk line installation is attached to the

1    affidavit.
2    (b) If the Commission receives an affidavit or affidavits
3meeting the requirements of subsection (a), the Commission
4shall reimburse the public safety agency, public agency,
5qualified governmental entity, or Emergency Telephone System
6Board for the installation of the additional trunk line to the
7public safety agency's 9-1-1 system within 90 days of receipt.
8    (c) After being reimbursed by the Commission for the
9installation of an additional trunk line under subsection (b),
10a public safety agency, public agency, qualified governmental
11entity, or Emergency Telephone System Board may request
12reimbursement for any repairs and monthly trunk line fees for
13the additional trunk line by submitting one or more affidavits,
14but no more than 4 requests may be submitted in any calendar
15year, requesting reimbursement of repairs and monthly trunk
16line fees. Invoices for any repairs and monthly trunk line fees
17must be attached to any affidavit submitted. The Commission
18must submit reimbursement for the repairs and monthly trunk
19line fees within 90 days of receipt.
20    (d) The Commission shall not reimburse a public safety
21agency, public agency, qualified governmental entity, or
22Emergency Telephone System Board for more than one additional
23trunk line and its related repairs and fees.
 
24    Section 99. Effective date. This Act takes effect upon
25becoming law.
