SYNOPSIS AS INTRODUCED:

625 ILCS 5/3-101.1 new
625 ILCS 45/3A-0.1 new

Amends the Illinois Vehicle Code. Provides that every owner of a watercraft for which no certificate of title has been issued shall make application to the Secretary of State for a certificate of title. Provides that the Secretary shall undertake all responsibilities related to the issuance and transfer of certificates of title, including rulemaking authority, for watercraft under the Boat Registration and Safety Act. Amends the Boat Registration and Safety Act. Provides that, notwithstanding any other provision of the Boat Registration and Safety Act, the Secretary of State shall issue all certificates of title and undertake all responsibilities related to the issuance and transfer of certificates of title, including rulemaking authority, for watercraft under that Act. Provides that the Department of Natural Resources shall not issue certificates of title or perform the responsibilities related to issuance or transfer of certificates of title.

A BILL FOR

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Vehicle Code is amended by adding Section 3-101.1 as follows:

Sec. 3-101.1. Watercraft certificate of title. Notwithstanding any other provisions of this Code or the Boat Registration and Safety Act, every owner of a watercraft, as defined in Section 1-2 of the Boat Registration and Safety Act, for which no certificate of title has been issued shall make application to the Secretary of State for a certificate of title, and the Secretary shall undertake all responsibilities related to the issuance and transfer of certificates of title, including rulemaking authority, for watercraft under the Boat Registration and Safety Act.

Section 10. The Boat Registration and Safety Act is amended by adding Section 3A-0.1 as follows:

Sec. 3A-0.1. Certificates of title issued by the Secretary of State. Notwithstanding any other provision of this Act, the Secretary of State shall issue all certificates of title for watercraft in this State for which no certificate of title has been issued, and undertake all responsibilities related to the issuance and transfer of certificates of title, including rulemaking authority, for watercraft under this Act. The Department of Natural Resources shall not issue or transfer certificates of title or perform the responsibilities related to issuance of certificates of title for watercraft.
