HOUSE RESOLUTION

WHEREAS, A Funeral Director in the State of Illinois must obtain a license from the Department of Financial and Professional Regulation; no person may practice funeral directing without a license, or without having a fixed place of practice or being employed by or under contract with an establishment devoted to that practice; and

WHEREAS, A Funeral Director cannot work out of a storefront, office space inside of an office building, or any other facility that is unlicensed as a stand-alone funeral parlor; and

WHEREAS, Any action of a person falsely claiming to be a licensed Funeral Director or working out of a temporary establishment is in violation of State law; and

WHEREAS, The license requirements for Funeral Directors are stated in the Funeral Directors and Embalmers Licensing Code (225 ILCS 41/5-5 et seq.); and

WHEREAS, It has become known in recent years that the practice of curbstone funeral directing is taking place in cities around the State; and

WHEREAS, The illegal practice of curbstone funeral directing is a major concern because it takes advantage of people during a difficult and emotional time; therefore, be it

RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we urge the Illinois Department of Financial and Professional Regulation to investigate the occurrences of illegal curbstone funeral directing across the State; and be it further

RESOLVED, That a suitable copy of this resolution be delivered to the Director of the Illinois Department of Financial and Professional Regulation.
