HOUSE RESOLUTION

 
2    WHEREAS, The members of the Illinois General Assembly
3passed Public Act 98-506 to ensure that anyone driving a car is
4careful, responsive, and alert behind the wheel; and
 
5    WHEREAS, Illinois joined a dozen other states with similar
6restrictions and will allow drivers to operate under a uniform
7ban; and
 
8    WHEREAS, Public Act 98-506 provided that Illinois drivers
9may not operate a motor vehicle on a roadway while using an
10electronic communication device; and
 
11    WHEREAS, A person who violates Public Act 98-508 will be
12fined a maximum of $75 for a first offense, $100 for a second
13offense, $125 for a third offense, and $150 for a fourth or
14subsequent offense; and
 
15    WHEREAS, A first offense for driving while using an
16electronic communication device will not be considered a moving
17violation; subsequent offences will be considered moving
18violations and will be recorded on one's driving record; and
 
19    WHEREAS, The new handheld cell phone ban is a primary stop
20offense, which means that a driver can be stopped without

1committing any other violation; and
 
2    WHEREAS, Public Act 98-506 was an initiative based on the
3National Transportation Safety Board's recommendation for a
4nationwide ban on the use of cell phones while driving; and
 
5    WHEREAS, Other states that have implemented the bans have
6done research, noting that there may be little difference
7between drivers who use hand-held cell phones and who use
8hands-free devices; and
 
9    WHEREAS, It is important for the Illinois General Assembly
10to evaluate the impact of legislation to insure the safety of
11all Illinois drivers; therefore, be it
 
12    RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
13NINETY-NINTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that we
14urge the Illinois State Police and the Illinois Department of
15Transportation to study the impact of Public Act 98-506 and to
16deliver a report to the members of the Illinois House of
17Representatives by January 1, 2016; and be it further
 
18    RESOLVED, That suitable copies of this resolution be
19presented to the Secretary of State Police and the Secretary of
20Transportation.
