    Amends the Illinois Vehicle Code. Beginning with the 2017 registration year, changes the registration periods for vehicles of the first division, vehicles of the second division under 8,000 lbs., motorcycles, motor driven cycles, recreational vehicles, and campers, from annual registration to biennial registration. Makes other conforming changes. Amends the Cycle Rider Safety Training Act to make conforming changes. Effective January 1, 2017.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Sections 1-171, 2-119, 3-403, 3-412, 3-413, 3-414, 3-414.1,
63-415, 3-607, 3-626, 3-803, 3-805.5, 3-806, 3-815, and 11-1303
7as follows:
 
8    (625 ILCS 5/1-171)  (from Ch. 95 1/2, par. 1-171)
9    Sec. 1-171. Registration - Registration Sticker.
10Registration. The registration certificate or certificates,
11registration plates and registration stickers issued under the
12laws of this State pertaining to the registration of vehicles.
13    Registration Sticker or Stickers. A device or devices to be
14attached to a rear registration plate that will renew the
15registration and registration plate or plates for a
16pre-determined period not to exceed 2 one registration years
17year except as provided in subsection (1) of Section 3-414 of
18this Code. Should the Secretary of State determine it is
19advisable to require a registration sticker to be attached to a
20front registration plate, he may require such action and
21provide the necessary additional sticker. Such determination
22shall be publicly announced at least 30 days in advance of a
23new annual registration period year.

3    Sec. 2-119. Disposition of fees and taxes.
4    (a) All moneys received from Salvage Certificates shall be
5deposited in the Common School Fund in the State Treasury.
6    (b) Of the money collected for each certificate of title,
7duplicate certificate of title, and corrected certificate of
8title:
9        (1) $2.60 shall be deposited in the Park and
10    Conservation Fund;
11        (2) $0.65 shall be deposited in the Illinois Fisheries
12    Management Fund;
13        (3) $48 shall be disbursed under subsection (g) of this
14    Section;
15        (4) $4 shall be deposited into the Motor Vehicle
16    License Plate Fund; and
17        (5) $30 shall be deposited into the Capital Projects
18    Fund.
19    All remaining moneys collected for certificates of title,
20and all moneys collected for filing of security interests,
21shall be deposited in the General Revenue Fund.
22    The $40 $20 collected for each delinquent vehicle
23registration renewal fee shall be deposited into the General
24Revenue Fund.
25    The moneys deposited in the Park and Conservation Fund

1under this Section shall be used for the acquisition and
2development of bike paths as provided for in Section 805-420 of
3the Department of Natural Resources (Conservation) Law of the
4Civil Administrative Code of Illinois. The moneys deposited
5into the Park and Conservation Fund under this subsection shall
6not be subject to administrative charges or chargebacks, unless
7otherwise authorized by this Code.
8    If the balance in the Motor Vehicle License Plate Fund
9exceeds $40,000,000 on the last day of a calendar month, then
10during the next calendar month, the $4 that otherwise would be
11deposited in that fund shall instead be deposited into the Road
12Fund.
13    (c) All moneys collected for that portion of a driver's
14license fee designated for driver education under Section 6-118
15shall be placed in the Driver Education Fund in the State
16Treasury.
17    (d) Of the moneys collected as a registration fee for each
18motorcycle, motor driven cycle, and moped, 27% shall be
19deposited in the Cycle Rider Safety Training Fund.
20    (e) (Blank).
21    (f) Of the total money collected for a commercial learner's
22permit (CLP) or original or renewal issuance of a commercial
23driver's license (CDL) pursuant to the Uniform Commercial
24Driver's License Act (UCDLA): (i) $6 of the total fee for an
25original or renewal CDL, and $6 of the total CLP fee when such
26permit is issued to any person holding a valid Illinois

1driver's license, shall be paid into the CDLIS/AAMVAnet/NMVTIS
2Trust Fund (Commercial Driver's License Information
3System/American Association of Motor Vehicle Administrators
4network/National Motor Vehicle Title Information Service Trust
5Fund) and shall be used for the purposes provided in Section
66z-23 of the State Finance Act and (ii) $20 of the total fee
7for an original or renewal CDL or CLP shall be paid into the
8Motor Carrier Safety Inspection Fund, which is hereby created
9as a special fund in the State Treasury, to be used by the
10Department of State Police, subject to appropriation, to hire
11additional officers to conduct motor carrier safety
12inspections pursuant to Chapter 18b of this Code.
13    (g) Of the moneys received by the Secretary of State as
14registration fees or taxes, certificates of title, duplicate
15certificates of title, corrected certificates of title, or as
16payment of any other fee under this Code, when those moneys are
17not otherwise distributed by this Code, 37% shall be deposited
18into the State Construction Account Fund, and 63% shall be
19deposited in the Road Fund. Moneys in the Road Fund shall be
20used for the purposes provided in Section 8.3 of the State
21Finance Act.
22    (h) (Blank).

25    (k) There is created in the State Treasury a special fund
26to be known as the Secretary of State Special License Plate

1Fund. Money deposited into the Fund shall, subject to
2appropriation, be used by the Office of the Secretary of State
3(i) to help defray plate manufacturing and plate processing
4costs for the issuance and, when applicable, renewal of any new
5or existing registration plates authorized under this Code and
6(ii) for grants made by the Secretary of State to benefit
7Illinois Veterans Home libraries.
8    (l) The Motor Vehicle Review Board Fund is created as a
9special fund in the State Treasury. Moneys deposited into the
10Fund under paragraph (7) of subsection (b) of Section 5-101 and
11Section 5-109 shall, subject to appropriation, be used by the
12Office of the Secretary of State to administer the Motor
13Vehicle Review Board, including without limitation payment of
14compensation and all necessary expenses incurred in
15administering the Motor Vehicle Review Board under the Motor
16Vehicle Franchise Act.
17    (m) Effective July 1, 1996, there is created in the State
18Treasury a special fund to be known as the Family
19Responsibility Fund. Moneys deposited into the Fund shall,
20subject to appropriation, be used by the Office of the
21Secretary of State for the purpose of enforcing the Family
22Financial Responsibility Law.
23    (n) The Illinois Fire Fighters' Memorial Fund is created as
24a special fund in the State Treasury. Moneys deposited into the
25Fund shall, subject to appropriation, be used by the Office of
26the State Fire Marshal for construction of the Illinois Fire

1Fighters' Memorial to be located at the State Capitol grounds
2in Springfield, Illinois. Upon the completion of the Memorial,
3moneys in the Fund shall be used in accordance with Section
43-634.
5    (o) Of the money collected for each certificate of title
6for all-terrain vehicles and off-highway motorcycles, $17
7shall be deposited into the Off-Highway Vehicle Trails Fund.
8    (p) For audits conducted on or after July 1, 2003 pursuant
9to Section 2-124(d) of this Code, 50% of the money collected as
10audit fees shall be deposited into the General Revenue Fund.

15    (625 ILCS 5/3-403)  (from Ch. 95 1/2, par. 3-403)
16    Sec. 3-403. Trip and Short-term permits.
17    (a) The Secretary of State may issue a short-term permit to
18operate a nonregistered first or second division vehicle within
19the State of Illinois for a period of not more than 7 days. Any
20second division vehicle operating on such permit may operate
21only on empty weight. The fee for the short-term permit shall
22be $6 for permits purchased on or before June 30, 2003 and $10
23for permits purchased on or after July 1, 2003. For short-term
24permits purchased on or after July 1, 2003, $4 of the fee
25collected for the purchase of each permit shall be deposited

1into the General Revenue Fund.
2    This permit may also be issued to operate an unladen
3registered vehicle which is suspended under the Vehicle
4Emissions Inspection Law and allow it to be driven on the roads
5and highways of the State in order to be repaired or when
6travelling to and from an emissions inspection station.
7    (b) The Secretary of State may, subject to reciprocal
8agreements, arrangements or declarations made or entered into
9pursuant to Section 3-402, 3-402.4 or by rule, provide for and
10issue registration permits for the use of Illinois highways by
11vehicles of the second division on an occasional basis or for a
12specific and special short-term use, in compliance with rules
13and regulations promulgated by the Secretary of State, and upon
14payment of the prescribed fee as follows:
15    One-trip permits. A registration permit for one trip, or
16one round-trip into and out of Illinois, for a period not to
17exceed 72 consecutive hours or 3 calendar days may be provided,
18for a fee as prescribed in Section 3-811.
19    One-Month permits. A registration permit for 30 days may be
20provided for a fee of $13 for registration plus 1/10 of the
21flat weight tax. The minimum fee for such permit shall be $31.
22    In-transit permits. A registration permit for one trip may
23be provided for vehicles in transit by the driveaway or towaway
24method and operated by a transporter in compliance with the
25Illinois Motor Carrier of Property Law, for a fee as prescribed
26in Section 3-811.

1    Illinois Temporary Apportionment Authorization Permits. An
2apportionment authorization permit for forty-five days for the
3immediate operation of a vehicle upon application for and prior
4to receiving apportioned credentials or interstate credentials
5from the State of Illinois. The fee for such permit shall be
6$3.
7    Illinois Temporary Prorate Authorization Permit. A prorate
8authorization permit for forty-five days for the immediate
9operation of a vehicle upon application for and prior to
10receiving prorate credentials or interstate credentials from
11the State of Illinois. The fee for such permit shall be $3.
12    (c) The Secretary of State shall promulgate by such rule or
13regulation, schedules of fees and taxes for such permits and in
14computing the amount or amounts due, may round off such amount
15to the nearest full dollar amount.
16    (d) The Secretary of State shall further prescribe the form
17of application and permit and may require such information and
18data as necessary and proper, including confirming the status
19or identity of the applicant and the vehicle in question.
20    (e) Rules or regulations promulgated by the Secretary of
21State under this Section shall provide for reasonable and
22proper limitations and restrictions governing the application
23for and issuance and use of permits, and shall provide for the
24number of permits per vehicle or per applicant, so as to
25preclude evasion of annual registration requirements as may be
26required by this Act.

1    (f) Any permit under this Section is subject to suspension
2or revocation under this Act, and in addition, any such permit
3is subject to suspension or revocation should the Secretary of
4State determine that the vehicle identified in any permit
5should be properly registered in Illinois. In the event any
6such permit is suspended or revoked, the permit is then null
7and void, may not be re-instated, nor is a refund therefor
8available. The vehicle identified in such permit may not
9thereafter be operated in Illinois without being properly
10registered as provided in this Chapter.

12    (625 ILCS 5/3-412)  (from Ch. 95 1/2, par. 3-412)
13    Sec. 3-412. Registration plates and registration stickers
14to be furnished by the Secretary of State.
15    (a) The Secretary of State upon registering a vehicle
16subject to biennial annual registration for the first time
17shall issue or shall cause to be issued to the owner one
18registration plate for a motorcycle, trailer, semitrailer,
19moped, autocycle, or truck-tractor, 2 registration plates for
20other motor vehicles and, where applicable, current
21registration stickers for motor vehicles of the first division.
22The provisions of this Section may be made applicable to such
23vehicles of the second division, as the Secretary of State may,
24from time to time, in his discretion designate. On subsequent
25biennial annual registrations during the term of the

1registration plate as provided in Section 3-414.1, the
2Secretary shall issue or cause to be issued registration
3stickers as evidence of current registration. However, the
4issuance of biennial annual registration stickers to vehicles
5registered under the provisions of Sections 3-402.1 and 3-405.3
6of this Code may not be required if the Secretary deems the
7issuance unnecessary.
8    (b) Every registration plate shall have displayed upon it
9the registration number assigned to the vehicle for which it is
10issued, the name of this State, which may be abbreviated, the
11year number for which it was issued, which may be abbreviated,
12the phrase "Land of Lincoln" (except as otherwise provided in
13this Code), and such other letters or numbers as the Secretary
14may prescribe. However, for apportionment plates issued to
15vehicles registered under Section 3-402.1 and fleet plates
16issued to vehicles registered under Section 3-405.3, the phrase
17"Land of Lincoln" may be omitted to allow for the word
18"apportioned", the word "fleet", or other similar language to
19be displayed. Registration plates issued to a vehicle
20registered as a fleet vehicle may display a designation
21determined by the Secretary.
22    The Secretary may in his discretion prescribe that letters
23be used as prefixes only on registration plates issued to
24vehicles of the first division which are registered under this
25Code and only as suffixes on registration plates issued to
26other vehicles. Every registration sticker issued as evidence

1of current registration shall designate the year number for
2which it is issued and such other letters or numbers as the
3Secretary may prescribe and shall be of a contrasting color
4with the registration plates and registration stickers of the
5previous registration period year.
6    (c) Each registration plate and the required letters and
7numerals thereon, except the year number for which issued,
8shall be of sufficient size to be plainly readable from a
9distance of 100 feet during daylight, and shall be coated with
10reflectorizing material. The dimensions of the plate issued to
11vehicles of the first division shall be 6 by 12 inches.
12    (d) The Secretary of State shall issue for every passenger
13motor vehicle rented without a driver the same type of
14registration plates as the type of plates issued for a private
15passenger vehicle.
16    (e) The Secretary of State shall issue for every passenger
17car used as a taxicab or livery, distinctive registration
18plates.
19    (f) The Secretary of State shall issue for every motorcycle
20distinctive registration plates distinguishing between
21motorcycles having 150 or more cubic centimeters piston
22displacement, or having less than 150 cubic centimeter piston
23displacement.
24    (g) Registration plates issued to vehicles for-hire may
25display a designation as determined by the Secretary that such
26vehicles are for-hire.

1    (h) (Blank).
2    (i) The Secretary of State shall issue for every public and
3private ambulance registration plates identifying the vehicle
4as an ambulance. The Secretary shall forward to the Department
5of Healthcare and Family Services registration information for
6the purpose of verification of claims filed with the Department
7by ambulance owners for payment for services to public
8assistance recipients.
9    (j) The Secretary of State shall issue for every public and
10private medical carrier or rescue vehicle livery registration
11plates displaying numbers within ranges of numbers reserved
12respectively for medical carriers and rescue vehicles. The
13Secretary shall forward to the Department of Healthcare and
14Family Services registration information for the purpose of
15verification of claims filed with the Department by owners of
16medical carriers or rescue vehicles for payment for services to
17public assistance recipients.
18    (k) The Secretary of State shall issue distinctive license
19plates or distinctive license plate stickers for every vehicle
20exempted from subsections (a) and (a-5) of Section 12-503 by
21subsection (g) of that Section, and by subsection (g-5) of that
22Section before its deletion by this amendatory Act of the 95th
23General Assembly. The Secretary shall issue these plates or
24stickers immediately upon receiving the physician's
25certification required under subsection (g) of Section 12-503.
26New plates or stickers shall also be issued when the

1certification is renewed as provided in that subsection.
2    (l) The Secretary of State shall issue distinctive
3registration plates for low-speed vehicles.
4    (m) The Secretary of State shall issue distinctive
5registration plates for autocycles. The dimensions of the plate
6issued to autocycles shall be 4 by 7 inches.

9    Sec. 3-413. Display of registration plates, registration
10stickers, and drive-away permits; registration plate covers.
11    (a) Registration plates issued for a motor vehicle other
12than a motorcycle, autocycle, trailer, semitrailer,
13truck-tractor, apportioned bus, or apportioned truck shall be
14attached thereto, one in the front and one in the rear. The
15registration plate issued for a motorcycle, autocycle, trailer
16or semitrailer required to be registered hereunder and any
17apportionment plate issued to a bus under the provisions of
18this Code shall be attached to the rear thereof. The
19registration plate issued for a truck-tractor or an apportioned
20truck required to be registered hereunder shall be attached to
21the front thereof.
22    (b) Except for vehicles with rear loaded motorized
23forklifts, every registration plate shall at all times be
24securely fastened in a horizontal position to the vehicle for
25which it is issued so as to prevent the plate from swinging and

1at a height of not less than 5 inches from the ground,
2measuring from the bottom of such plate, in a place and
3position to be clearly visible and shall be maintained in a
4condition to be clearly legible, free from any materials that
5would obstruct the visibility of the plate. A registration
6plate on a motorcycle may be mounted vertically as long as it
7is otherwise clearly visible. Registration stickers issued as
8evidence of renewed biennial annual registration shall be
9attached to registration plates as required by the Secretary of
10State, and be clearly visible at all times. For those vehicles
11with rear loaded motorized forklifts, if the rear plate is
12securely fastened in a horizontal position as prescribed, the
13plate and registration sticker shall not be required to be
14clearly visible at all times as a result of the rear mounted
15motorized forklift obstructing the view.
16    (c) Every drive-away permit issued pursuant to this Code
17shall be firmly attached to the motor vehicle in the manner
18prescribed by the Secretary of State. If a drive-away permit is
19affixed to a motor vehicle in any other manner the permit shall
20be void and of no effect.
21    (d) The Illinois prorate decal issued to a foreign
22registered vehicle part of a fleet prorated or apportioned with
23Illinois, shall be displayed on a registration plate and
24displayed on the front of such vehicle in the same manner as an
25Illinois registration plate.
26    (e) The registration plate issued for a camper body mounted

1on a truck displaying registration plates shall be attached to
2the rear of the camper body.
3    (f) No person shall operate a vehicle, nor permit the
4operation of a vehicle, upon which is displayed an Illinois
5registration plate, plates or registration stickers, except as
6provided for in subsection (b) of Section 3-701 of this Code,
7after the termination of the registration period for which
8issued or after the expiration date set pursuant to Sections
93-414 and 3-414.1 of this Code.
10    (g) A person may not operate any motor vehicle that is
11equipped with registration plate covers. A violation of this
12subsection (g) or a similar provision of a local ordinance is
13an offense against laws and ordinances regulating the movement
14of traffic.
15    (h) A person may not sell or offer for sale a registration
16plate cover. A violation of this subsection (h) is a business
17offense.
18    (i) A person may not advertise for the purpose of promoting
19the sale of registration plate covers. A violation of this
20subsection (i) is a business offense.
21    (j) A person may not modify the original manufacturer's
22mounting location of the rear registration plate on any vehicle
23so as to conceal the registration or to knowingly cause it to
24be obstructed in an effort to hinder a peace officer from
25obtaining the registration for the enforcement of a violation
26of this Code, Section 27.1 of the Toll Highway Act concerning

1toll evasion, or any municipal ordinance. Modifications
2prohibited by this subsection (j) include but are not limited
3to the use of an electronic device. A violation of this
4subsection (j) is a Class A misdemeanor.

7    (625 ILCS 5/3-414)  (from Ch. 95 1/2, par. 3-414)
8    Sec. 3-414. Expiration of registration.
9    (a) Every vehicle registration under this Chapter and every
10registration card and registration plate or registration
11sticker issued hereunder to a vehicle shall be for the periods
12specified in this Chapter and shall expire at midnight on the
13day and date specified in this Section as follows:
14        1. (Blank); When registered on a calendar year basis
15    commencing January 1, expiration shall be on the 31st day
16    of December or at such other date as may be selected in the
17    discretion of the Secretary of State; however, through
18    December 31, 2004, registrations of apportionable
19    vehicles, motorcycles, motor driven cycles and pedalcycles
20    shall commence on the first day of April and shall expire
21    March 31st of the following calendar year;
22        1.1. Beginning January 1, 2005, registrations of
23    motorcycles and motor driven cycles shall commence on
24    January 1 and shall expire on December 31 or on another
25    date that may be selected by the Secretary; registrations

1    of apportionable vehicles and pedalcycles, however, shall
2    commence on the first day of April and shall expire March
3    31 of the following calendar year. Beginning January 1,
4    2017, registrations of motorcycles and motor driven cycles
5    shall commence on January 1, 2017 and shall expire on
6    December 31 of the ensuing odd-numbered year, or at a later
7    date as may be selected in the discretion of the Secretary
8    of State not beyond March 1 next;
9        2. Beginning January 1, 2017, motor vehicles shall be
10    When registered on a 2 calendar year basis commencing
11    January 1, 2017 of an even-numbered year, expiration shall
12    be on the 31st day of December of the ensuing even-numbered
13    odd-numbered year, or at such other later date as may be
14    selected in the discretion of the Secretary of State not
15    beyond March 1 next;
16        3. When registered on a fiscal year basis commencing
17    July 1, expiration shall be on the 30th day of June or at
18    such other later date as may be selected in the discretion
19    of the Secretary of State not beyond September 1 next;
20        4. When registered on a 2 fiscal year basis commencing
21    July 1 of an even-numbered year, expiration shall be on the
22    30th day of June of the ensuing even-numbered year, or at
23    such other later date as may be selected in the discretion
24    of the Secretary of State not beyond September 1 next;
25        5. When registered on a 4 fiscal year basis commencing
26    July 1 of an even-numbered year, expiration shall be on the

1    30th day of June of the second ensuing even-numbered year,
2    or at such other later date as may be selected in the
3    discretion of the Secretary of State not beyond September 1
4    next;
5    (b) Vehicle registrations of vehicles of the first division
6shall be for a calendar year, 2 calendar year, 3 calendar year,
7or 5 calendar year basis as provided for in this Chapter.
8    Vehicle registrations of vehicles under Sections 3-807,
93-808 and 3-809 shall be on an indefinite term basis or a 2
10calendar year basis as provided for in this Chapter.
11    Vehicle registrations for vehicles of the second division
12shall be for a fiscal year, 2 fiscal year or calendar year
13basis as provided for in this Chapter.
14    Motor vehicles registered under the provisions of Section
153-402.1 shall be issued multi-year registration plates with a
16new registration card issued annually upon payment of the
17appropriate fees. Motor vehicles registered under the
18provisions of Section 3-405.3 shall be issued multi-year
19registration plates with a new multi-year registration card
20issued pursuant to subsections (j), (k), and (l) of this
21Section upon payment of the appropriate fees. Apportionable
22trailers and apportionable semitrailers registered under the
23provisions of Section 3-402.1 shall be issued multi-year
24registration plates and cards that will be subject to
25revocation for failure to pay annual fees required by Section
263-814.1. The Secretary shall determine when these vehicles

1shall be issued new registration plates.
2    (c) Every vehicle registration specified in Section 3-810
3and every registration card and registration plate or
4registration sticker issued thereunder shall expire on the 31st
5day of December of each year or at such other date as may be
6selected in the discretion of the Secretary of State.
7    (d) Every vehicle registration for a vehicle of the second
8division weighing over 8,000 pounds, except as provided in
9paragraph (g) of this Section, and every registration card and
10registration plate or registration sticker, where applicable,
11issued hereunder to such vehicles shall be issued for a fiscal
12year commencing on July 1st of each registration year. However,
13the Secretary of State may, pursuant to an agreement or
14arrangement or declaration providing for apportionment of a
15fleet of vehicles with other jurisdictions, provide for
16registration of such vehicles under apportionment or for all of
17the vehicles registered in Illinois by an applicant who
18registers some of his vehicles under apportionment on a
19calendar year basis instead, and the fees or taxes to be paid
20on a calendar year basis shall be identical to those specified
21in this Act for a fiscal year registration. Provision for
22installment payment may also be made.
23    (e) Semitrailer registrations under apportionment may be
24on a calendar year under a reciprocal agreement or arrangement
25and all other semitrailer registrations shall be on fiscal year
26or 2 fiscal year or 4 fiscal year basis as provided for in this

2    (f) The Secretary of State may convert annual registration
3plates or 2-year registration plates, whether registered on a
4calendar year or fiscal year basis, to multi-year plates. The
5determination of which plate categories and when to convert to
6multi-year plates is solely within the discretion of the
7Secretary of State.
8    (g) After January 1, 1975, each registration, registration
9card and registration plate or registration sticker, where
10applicable, issued for a recreational vehicle or recreational
11or camping trailer, except a house trailer, used exclusively by
12the owner for recreational purposes, and not used commercially
13nor as a truck or bus, nor for hire, shall be on a calendar year
14basis; except that the Secretary of State shall provide for
15registration and the issuance of registration cards and plates
16or registration stickers, where applicable, for one 6-month
17period in order to accomplish an orderly transition from a
18fiscal year to a calendar year basis. Fees and taxes due under
19this Act for a registration year shall be appropriately reduced
20for such 6-month transitional registration period. Beginning
21January 1, 2017 each registration, registration card and
22registration plate or registration sticker, when applicable,
23issued for a recreational vehicle or recreational or camping
24trailer, except a house trailer, used exclusively by the owner
25for recreational purposes, and not used commercially nor as a

1basis; except that the Secretary of State shall provide for
2registration and the issuance of registration cards and plates
3or registration stickers, when applicable, for one 6-month
4period in order to accomplish an orderly transition from a
5fiscal year to a 2 calendar year basis. Fees and taxes due
6under this Act for a registration year shall be appropriately
7reduced for the 6-month transitional registration period.
8    (h) The Secretary of State may, in order to accomplish an
9orderly transition for vehicles registered under Section
103-402.1 of this Code from a calendar year registration to a
11March 31st expiration, require applicants to pay fees and taxes
12due under this Code on a 15 month registration basis. However,
13if in the discretion of the Secretary of State this creates an
14undue hardship on any applicant the Secretary may allow the
15applicant to pay 3 month fees and taxes at the time of
16registration and the additional 12 month fees and taxes to be
17payable no later than March 31 of the year after this
18amendatory Act of 1991 takes effect.
19    (i) The Secretary of State may stagger registrations, or
20change the biennial annual expiration date, as necessary for
21the convenience of the public and the efficiency of his Office.
22In order to appropriately and effectively accomplish any such
23staggering, the Secretary of State is authorized to prorate all
24required registration fees, rounded to the nearest dollar, but
25in no event for a period longer than 28 18 months, at a monthly
26rate for a 24 12 month registration fee.

1    (j) The Secretary of State may enter into an agreement with
2a rental owner, as defined in Section 3-400 of this Code, who
3registers a fleet of motor vehicles of the first division
4pursuant to Section 3-405.3 of this Code to provide for the
5registration of the rental owner's vehicles on a 2 or 3
6calendar year basis and the issuance of multi-year registration
7plates with a new registration card issued up to every 3 years.
8    (k) The Secretary of State may provide multi-year
9registration cards for any registered fleet of motor vehicles
10of the first or second division that are registered pursuant to
11Section 3-405.3 of this Code. Each motor vehicle of the
12registered fleet must carry an unique multi-year registration
13card that displays the vehicle identification number of the
14registered motor vehicle. The Secretary of State shall
15promulgate rules in order to implement multi-year
16registrations.
17    (l) Beginning with the 2018 registration year, the
18Secretary of State may enter into an agreement with a rental
19owner, as defined in Section 3-400 of this Code, who registers
20a fleet of motor vehicles of the first division under Section
213-405.3 of this Code to provide for the registration of the
22rental owner's vehicle on a 5 calendar year basis. Motor
23vehicles registered on a 5 calendar year basis shall be issued
24a distinct registration plate that expires on a 5-year cycle.
25The Secretary may prorate the registration of these
26registration plates to the length of time remaining in the

15-year cycle. The Secretary may adopt any rules necessary to
2implement this subsection.

5    Sec. 3-414.1. Term of multi-year registration plates.
6    (a) Registration plates issued for motor vehicles shall be
7valid for an indefinite term of not less than 2 years one year.
8Registration plates issued as two-year or five-year plates may

10Secretary of State. Current renewal registration stickers,
11when necessary, are to be attached as provided in Section

15payment of the registration fee and tax for such vehicle as
16provided by law, except that application for renewal of a
17vehicle registration, as to those vehicles required to be
18registered on a staggered fiscal year basis, shall be made by
19the owner in the form and manner prescribed by the Secretary of
20State.
21    (c) Two calendar years. Application for renewal of a
22vehicle registration shall be made by the owner, as to those
23vehicles required to be registered for 2 calendar years, not
24later than December 1 of the year preceding commencement of the
252-year registration period, except that application for

6required to be registered for 2 fiscal years, not later than
7June 1 immediately preceding commencement of the 2-year
8registration period, except that application for renewal of a
9vehicle registration, as to those vehicles required to be
10registered for 2 fiscal years on a staggered registration
11basis, shall be made by the owner in the form and manner
12prescribed by the Secretary of State.
13    (d-5) Three calendar years. Application for renewal of a
14vehicle registration shall be made by the owner, as to those
15vehicles required to be registered for 3 calendar years, not
16later than December 1 of the year preceding commencement of the
173-year registration period.
18    (d-10) Five calendar years. Application for renewal of a
19vehicle registration shall be made by the owner, as to those
20vehicles required to be registered for 5 calendar years, not
21later than December 1 of the year preceding commencement of the
225-year registration period.
23    (e) Time of application. The Secretary of State may receive
24applications for renewal of registration and grant the same and
25issue new registration cards and plates or registration
26stickers at any time prior to expiration of registration. No

1person shall display upon a vehicle, the new registration
2plates or registration stickers prior to the dates the
3Secretary of State in his discretion may select.
4    (f) Verification. The Secretary of State may further
5require, as to vehicles for-hire, that applications be
6accompanied by verification that fees due under the Illinois
7Motor Carrier of Property Law, as amended, have been paid.
8    (g) (Blank).
9    (h) Returning combat mission veterans. Beginning in
10registration year 2017, the application for renewal, and
11subsequent fees, of a vehicle registration for a member of the
12active-duty or reserve component of the United States Armed
13Forces returning from a combat mission shall not be required
14for that service member's next scheduled renewal. Proof of
15combat mission service shall come from the service member's
16hostile fire pay or imminent danger pay documentation received
17any time in the 12 months preceding the registration renewal.
18Nothing in this subsection is applicable to the additional fees
19incurred by specialty, personalized, or vanity license plates.

7    (625 ILCS 5/3-626)
8    Sec. 3-626. Korean War Veteran license plates.
9    (a) In addition to any other special license plate, the
10Secretary, upon receipt of all applicable fees and applications
11made in the form prescribed by the Secretary of State, may
12issue special registration plates designated as Korean War
13Veteran license plates to residents of Illinois who
14participated in the United States Armed Forces during the
15Korean War. The special plate issued under this Section shall
16be affixed only to passenger vehicles of the first division,
17motorcycles, motor vehicles of the second division weighing not
18more than 8,000 pounds, and recreational vehicles as defined by
19Section 1-169 of this Code. Plates issued under this Section
20shall expire according to the staggered multi-year procedure
21established by Section 3-414.1 of this Code.
22    (b) The design, color, and format of the plates shall be
23wholly within the discretion of the Secretary of State. The
24Secretary may, in his or her discretion, allow the plates to be
25issued as vanity plates or personalized in accordance with

1Section 3-405.1 of this Code. The plates are not required to
2designate "Land Of Lincoln", as prescribed in subsection (b) of
3Section 3-412 of this Code. The Secretary shall prescribe the
4eligibility requirements and, in his or her discretion, shall
5approve and prescribe stickers or decals as provided under
6Section 3-412.
7    (c) (Blank).
8    (d) The Korean War Memorial Construction Fund is created as
9a special fund in the State treasury. All moneys in the Korean
10War Memorial Construction Fund shall, subject to
11appropriation, be used by the Department of Veteran Affairs to
12provide grants for construction of the Korean War Memorial to
13be located at Oak Ridge Cemetery in Springfield, Illinois. Upon
14the completion of the Memorial, the Department of Veteran
15Affairs shall certify to the State Treasurer that the
16construction of the Memorial has been completed. Upon the
17certification by the Department of Veteran Affairs, the State
18Treasurer shall transfer all moneys in the Fund and any future
19deposits into the Fund into the Secretary of State Special
20License Plate Fund.
21    (e) An individual who has been issued Korean War Veteran
22license plates for a vehicle and who has been approved for
23benefits under the Senior Citizens and Persons with
24Disabilities Property Tax Relief Act shall pay the original
25issuance and the regular annual fee for the registration of the
26vehicle as provided in Section 3-806.3 of this Code.

4    Sec. 3-803. Reductions.
5    (a) Reduction of fees and taxes prescribed in this Chapter
6shall be applicable only to vehicles newly-acquired by the
7owner after the beginning of a registration period or which
8become subject to registration after the beginning of a
9registration period as specified in this Act. The Secretary of
10State may deny a reduction as to any vehicle operated in this
11State without being properly and timely registered in Illinois
12under this Chapter, of a vehicle in violation of any provision
13of this Chapter, or upon detection of such violation by an
14audit, or upon determining that such vehicle was operated in
15Illinois before such violation. Bond or other security in the
16proper amount may be required by the Secretary of State while
17the matter is under investigation. Reductions shall be granted
18if a person becomes the owner after the dates specified or if a
19vehicle becomes subject to registration under this Act, as
20amended, after the dates specified.
21    (b) Vehicles of the First Division. The biennial annual
22fees and taxes prescribed by Section 3-806 shall be reduced by
2350% on and after June 15, except as provided in Sections 3-414
24and 3-802 of this Act.
25    (c) Vehicles of the Second Division. The annual fees and

1taxes prescribed by Sections 3-402, 3-402.1, 3-815 and 3-819
2and paid on a calendar year for such vehicles shall be reduced
3on a quarterly basis if the vehicle becomes subject to
4registration on and after March 31, June 30 or September 30.
5Where such fees and taxes are payable on a fiscal year basis,
6they shall be reduced on a quarterly basis on and after
7September 30, December 31 or March 31.
8    (d) Two-year Registrations. The fees and taxes prescribed
9by Section 3-808 for 2-year registrations shall not be reduced
10in any event. However, the fees and taxes prescribed for all
11other 2-year registrations by this Act, shall be reduced as
12follows:
13    By 25% on and after June 15;
14    By 50% on and after December 15;
15    By 75% on and after the next ensuing June 15.
16    (e) The registration fees and taxes imposed upon certain
17vehicles shall not be reduced by any amount in any event in the
18following instances:
19    Permits under Sections 3-403 and 3-811;
20    Municipal Buses under Section 3-807;
21    Governmental or charitable vehicles under Section 3-808;
22    Farm Machinery under Section 3-809;
23    Soil and conservation equipment under Section 3-809.1;
24    Special Plates under Section 3-810;
25    Permanently mounted equipment under Section 3-812;
26    Registration fee under Section 3-813;

8    (f) The reductions provided for shall not apply to any
9vehicle of the first or second division registered by the same
10applicant in the prior registration year.
11    The changes to this Section made by Public Act 84-210 take
12effect with the 1986 Calendar Registration Year.
13    (g) Reductions shall in no event result in payment of a fee
14or tax less than $6, and the Secretary of State shall
15promulgate schedules of fees reflecting applicable reductions.
16Where any reduced amount is not stated in full dollars, the
17Secretary of State may adjust the amount due to the nearest
18full dollar amount.
19    (h) The reductions provided for in subsections (a) through
20(g) of this Section shall not apply to those vehicles of the
21first or second division registered on a staggered registration
22basis.
23    (i) A vehicle which becomes subject to registration during
24the last month of the current registration year is exempt from
25any applicable reduced fourth quarter or second semiannual
26registration fee, and may register for the subsequent

1gross weight limitations in subsection (a) of Section 15-111
2for which the owner of the vehicle or combination of vehicles
3has elected to pay, in addition to the registration fee in
4subsection (a), $125 to the Secretary of State for each
5registration year. The Secretary shall designate this class of
6vehicle as a Special Hauling Vehicle.
7    (a-5) Beginning January 1, 2015, upon the request of the
8vehicle owner, a $10 surcharge shall be collected in addition
9to the above fees for vehicles in the 12,000 lbs. and less flat
10weight plate categories as described in subsection (a) to be
11deposited into the Secretary of State Special License Plate
12Fund. The $10 surcharge is to identify vehicles in the 12,000
13lbs. and less flat weight plate categories as a covered farm
14vehicle. The $10 surcharge is an annual, flat fee that shall be
15based on an applicant's new or existing registration year for
16each vehicle in the 12,000 lbs. and less flat weight plate
17categories. A designation as a covered farm vehicle under this
18subsection (a-5) shall not alter a vehicle's registration as a
19registration in the 12,000 lbs. or less flat weight category.
20The Secretary shall adopt any rules necessary to implement this
21subsection (a-5).
22    (b) Except as provided in Section 3-806.3, every camping
23trailer, motor home, mini motor home, travel trailer, truck

19    In the event the Secretary of State revokes a farm truck
20registration as authorized by law, the owner shall pay the flat
21weight tax due hereunder before operating such truck.
22    Any combination of vehicles having 5 axles, with a distance
23of 42 feet or less between extreme axles, that are subject to
24the weight limitations in subsection (a) of Section 15-111 for
25which the owner of the combination of vehicles has elected to
26pay, in addition to the registration fee in subsection (c),

1$125 to the Secretary of State for each registration year shall
2be designated by the Secretary as a Special Hauling Vehicle.
3    (d) The number of axles necessary to carry the maximum load
4provided shall be determined from Chapter 15 of this Code.
5    (e) An owner may only apply for and receive 5 farm truck
6registrations, and only 2 of those 5 vehicles shall exceed
759,500 gross weight in pounds per vehicle.
8    (f) Every person convicted of violating this Section by
9failure to pay the appropriate flat weight tax to the Secretary
10of State as set forth in the above tables shall be punished as
11provided for in Section 3-401.

16    Sec. 11-1303. Stopping, standing or parking prohibited in
17specified places.
18    (a) Except when necessary to avoid conflict with other
19traffic, or in compliance with law or the directions of a
20police officer or official traffic-control device, no person
21shall:
22        1. Stop, stand or park a vehicle:
23            a. On the roadway side of any vehicle stopped or
24        parked at the edge or curb of a street;
25            b. On a sidewalk;

1            c. Within an intersection;
2            d. On a crosswalk;
3            e. Between a safety zone and the adjacent curb or
4        within 30 feet of points on the curb immediately
5        opposite the ends of a safety zone, unless a different
6        length is indicated by signs or markings;
7            f. Alongside or opposite any street excavation or
8        obstruction when stopping, standing or parking would
9        obstruct traffic;
10            g. Upon any bridge or other elevated structure upon
11        a highway or within a highway tunnel;
12            h. On any railroad tracks. A violation of any part
13        of this subparagraph h. shall result in a mandatory
14        fine of $500 or 50 hours of community service.
15            i. At any place where official signs prohibit
16        stopping;
17            j. On any controlled-access highway;
18            k. In the area between roadways of a divided
19        highway, including crossovers;
20            l. In a public parking area if the vehicle does not
21        display a current annual registration sticker or
22        current temporary permit pending registration.
23        2. Stand or park a vehicle, whether occupied or not,
24    except momentarily to pick up or discharge passengers:
25            a. In front of a public or private driveway;
26            b. Within 15 feet of a fire hydrant;

1            c. Within 20 feet of a crosswalk at an
2        intersection;
3            d. Within 30 feet upon the approach to any flashing
4        signal, stop sign, yield sign, or traffic control
5        signal located at the side of a roadway;
6            e. Within 20 feet of the driveway entrance to any
7        fire station and on the side of a street opposite the
8        entrance to any fire station within 75 feet of such
9        entrance (when properly sign-posted);
10            f. At any place where official signs prohibit
11        standing.
12        3. Park a vehicle, whether occupied or not, except
13    temporarily for the purpose of and while actually engaged
14    in loading or unloading property or passengers:
15            a. Within 50 feet of the nearest rail of a railroad
16        crossing;
17            b. At any place where official signs prohibit
18        parking.
19    (b) No person shall move a vehicle not lawfully under his
20control into any such prohibited area or away from a curb such
21distance as is unlawful.

23    Section 10. The Cycle Rider Safety Training Act is amended
24by changing Section 6 as follows:

2    Sec. 6. To finance the Cycle Rider Safety Training program
3and to pay the costs thereof, the Secretary of State will
4hereafter deposit with the State Treasurer an amount equal to
5each biennial annual fee and each reduced fee, for the
6registration of each motorcycle, motor driven cycle and moped
7processed by the Office of the Secretary of State during the
8preceding quarter as required in subsection (d) of Section
92-119 of the Illinois Vehicle Code, which amount the State
10Comptroller shall transfer quarterly to a trust fund outside of
11the State treasury to be known as the Cycle Rider Safety
12Training Fund, which is hereby created. In addition, the
13Department may accept any federal, State, or private moneys for
14deposit into the Fund and shall be used by the Department only
15for the expenses of the Department in administering the
16provisions of this Act, for funding of contracts with approved
17Regional Cycle Rider Safety Training Centers for the conduct of
18courses, or for any purpose related or incident thereto and
19connected therewith.
