SYNOPSIS AS INTRODUCED:

625 ILCS 5/3-804.4 new

    Amends the Illinois Vehicle Code. Defines "high-end vehicle" as a vehicle having an estimated value of more than $50,000 at the time of initial registration. Provides that an owner of a high-end vehicle may choose to register the vehicle as a high-end vehicle for a fee twice the current standard registration fee. Provides that a high-end vehicle registration exempts the owner from placing a front license plate on the high-end vehicle.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 3-413 and by adding Sections 1-125.5 and 3-804.4 as
6follows:
 
7    (625 ILCS 5/1-125.5 new)
8    Sec. 1-125.5. High-end vehicle. Any motor vehicle having an
9estimated value of more than $50,000 at the time of initial
10registration.
 
11    (625 ILCS 5/3-413)  (from Ch. 95 1/2, par. 3-413)
12    Sec. 3-413. Display of registration plates, registration
13stickers, and drive-away permits; registration plate covers.
14    (a) Registration plates issued for a motor vehicle other
15than a high-end vehicle with an appropriate rear license plate
16designation, motorcycle, autocycle, trailer, semitrailer,
17truck-tractor, apportioned bus, or apportioned truck shall be
18attached thereto, one in the front and one in the rear. The
19registration plate issued for a high-end vehicle, motorcycle,
20autocycle, trailer or semitrailer required to be registered
21hereunder and any apportionment plate issued to a bus under the
22provisions of this Code shall be attached to the rear thereof.

1The registration plate issued for a truck-tractor or an
2apportioned truck required to be registered hereunder shall be
3attached to the front thereof.
4    (b) Except for vehicles with rear loaded motorized
5forklifts, every registration plate shall at all times be
6securely fastened in a horizontal position to the vehicle for
7which it is issued so as to prevent the plate from swinging and
8at a height of not less than 5 inches from the ground,
9measuring from the bottom of such plate, in a place and
10position to be clearly visible and shall be maintained in a
11condition to be clearly legible, free from any materials that
12would obstruct the visibility of the plate. A registration
13plate on a motorcycle may be mounted vertically as long as it
14is otherwise clearly visible. Registration stickers issued as
15evidence of renewed annual registration shall be attached to
16registration plates as required by the Secretary of State, and
17be clearly visible at all times. For those vehicles with rear
18loaded motorized forklifts, if the rear plate is securely
19fastened in a horizontal position as prescribed, the plate and
20registration sticker shall not be required to be clearly
21visible at all times as a result of the rear mounted motorized
22forklift obstructing the view.
23    (c) Every drive-away permit issued pursuant to this Code
24shall be firmly attached to the motor vehicle in the manner
25prescribed by the Secretary of State. If a drive-away permit is
26affixed to a motor vehicle in any other manner the permit shall

1be void and of no effect.
2    (d) The Illinois prorate decal issued to a foreign
3registered vehicle part of a fleet prorated or apportioned with
4Illinois, shall be displayed on a registration plate and
5displayed on the front of such vehicle in the same manner as an
6Illinois registration plate.
7    (e) The registration plate issued for a camper body mounted
8on a truck displaying registration plates shall be attached to
9the rear of the camper body.
10    (f) No person shall operate a vehicle, nor permit the
11operation of a vehicle, upon which is displayed an Illinois
12registration plate, plates or registration stickers, except as
13provided for in subsection (b) of Section 3-701 of this Code,
14after the termination of the registration period for which
15issued or after the expiration date set pursuant to Sections
163-414 and 3-414.1 of this Code.
17    (g) A person may not operate any motor vehicle that is
18equipped with registration plate covers. A violation of this
19subsection (g) or a similar provision of a local ordinance is
20an offense against laws and ordinances regulating the movement
21of traffic.
22    (h) A person may not sell or offer for sale a registration
23plate cover. A violation of this subsection (h) is a business
24offense.
25    (i) A person may not advertise for the purpose of promoting
26the sale of registration plate covers. A violation of this

1subsection (i) is a business offense.
2    (j) A person may not modify the original manufacturer's
3mounting location of the rear registration plate on any vehicle
4so as to conceal the registration or to knowingly cause it to
5be obstructed in an effort to hinder a peace officer from
6obtaining the registration for the enforcement of a violation
7of this Code, Section 27.1 of the Toll Highway Act concerning
8toll evasion, or any municipal ordinance. Modifications
9prohibited by this subsection (j) include but are not limited
10to the use of an electronic device. A violation of this
11subsection (j) is a Class A misdemeanor.

14    (625 ILCS 5/3-804.4 new)
15    Sec. 3-804.4. High-end vehicles. An owner of a high-end
16vehicle, as defined under Section 1-125.5, may register the
17vehicle as a high-end motor vehicle for twice the current
18annual registration fee amount under Section 3-806 and shall
19receive a special plate designation. This designation shall
20exempt the vehicle from the front license plate requirement
21under subsection (a) of Section 3-413. The Secretary may, in
22the Secretary's discretion, prescribe that the plates be issued
23for a definite or indefinite term, corresponding to the term of
24registration plates issued generally under Section 3-414.1.
