415 ILCS 5/3.535  was 415 ILCS 5/3.53

    Amends the Environmental Protection Act. Provides that "waste" does not include steel slag products. Defines "steel slag products". Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Environmental Protection Act is amended by
5changing Section 3.535 and by adding Section 3.477 as follows:
 
6    (415 ILCS 5/3.477 new)
7    Sec. 3.477. Steel slag products. "Steel slag products"
8means steel slag or mill scale that is a product of the
9steelmaking process; provided, that such steel slag or mill
10scale is sold and distributed in the stream of commerce for
11consumption, use, or further processing into another desired
12commodity and is managed as an item of commercial value in a
13controlled manner and not as a discarded material.

15    Sec. 3.535. Waste. "Waste" means any garbage, sludge from
16a waste treatment plant, water supply treatment plant, or air
17pollution control facility or other discarded material,
18including solid, liquid, semi-solid, or contained gaseous
19material resulting from industrial, commercial, mining and
20agricultural operations, and from community activities, but
21does not include solid or dissolved material in domestic
22sewage, or solid or dissolved materials in irrigation return

1flows, or steel slag products as defined in Section 3.477, or
2coal combustion by-products as defined in Section 3.135, or
3industrial discharges which are point sources subject to
4permits under Section 402 of the Federal Water Pollution
5Control Act, as now or hereafter amended, or source, special
6nuclear, or by-product materials as defined by the Atomic
7Energy Act of 1954, as amended (68 Stat. 921) or any solid or
8dissolved material from any facility subject to the Federal
9Surface Mining Control and Reclamation Act of 1977 (P.L. 95-87)
10or the rules and regulations thereunder or any law or rule or
11regulation adopted by the State of Illinois pursuant thereto.

13    Section 99. Effective date. This Act takes effect upon
14becoming law.
